Dear Sir, 
We refer to your e-mail dated 17 November 2016 in which you make a request for access to documents, 
registered the following day under the above mentioned reference number. You request access to all the 
contracts and written agreements which are currently in force between EU institutions and airline/train 
companies on the use of their service by EU Commissioners and/or staff.  
Since the documents concerned originate from third parties, the originators of the documents have been 
consulted. Following an examination of the documents requested under the provisions of Regulation (EC) 
No 1049/2001 regarding public access to documents and taking into account the opinion of the third parties, 
I regret to inform you that your application cannot be granted, as disclosure is prevented by an exception to 
the right of access laid down in Article 4 of this Regulation. Indeed the documents which you seek to obtain 
contain commercially sensitive business information of the companies that submitted them. The authors of 
the documents have objected to disclosure of documents that they sent to the Commission and have 
motivated their position on the basis of the grounds specified above. 
In accordance with Article 7(2) of Regulation 1049/2001, you are entitled, in accordance with Article 7(2) of 
Regulation 1049/2001, to make a confirmatory application requesting the Commission to review this position. 
Such a confirmatory application should be addressed within 15 working days upon receipt of this letter to the 
Secretary-General of the Commission at the following address:
