Dear Colleagues,
At this Presidency’s last working party meeting held on the 17th May 2017
we continued with our fruitful discussions on the Presidency’s second
Issues Paper covering Article 10 (Negotiation Mechanism) to Article 17
(Final Provisions – Amendments to other Directives) of the Directive on
Copyright in the Digital Single Market.
Our next working party on Intellectual Property (Copyright) will be
convened on the 22nd & 23rd May 2017 and we look forward to having
another positive and useful meeting. Through this flash we would like to
inform you of how the Presidency would like, with your continued
cooperation, to proceed during this meeting.
On Monday 22nd May we shall commence this Working Party Meeting at
10.00am. and intend to resume our discussion on the Presidency’s Second
Issues Paper with our focus being Article 13 which deals with Certain Uses
of protected content by online services. We will continue to examine in an
analytical manner and consider a number of issues in the proposal which
seem to create scepticism and raise a number of reservations. It is our
intention that at Monday’s session we will try to concentrate our discussion
on questions relating to the scope of services covered by Article 13 and
whether these need to be further clarified and how. This aspect will be
followed by other questions raised by delegations in respect to whether the
two types of information and reporting obligations are sufficiently clear
and whether Art 13 (1) requires amending. Another area that seems to
deserve further discussion is related to the redress mechanism to ensure
users’ protection.
On Tuesday 23rd May we intend to begin examining the First Presidency
Compromise Text concerning Articles 2 – 9 and which has been sent to
2017 Maltese Presidency of the Council of the EU

delegations in document 8929/17. The aim is to cover as much of the text as
possible throughout the day.
This First compromise text reflects comments made by delegations during
our Working Party meetings which have discussed the Commission’s
proposal. As such, the Presidency would like to emphasize that comments
and feedback made will be taken into consideration at a later stage
throughout the duration of the discussions.
We look forward to the upcoming discussions and to seeing you all at our
next meeting.
