As per your request at this week’s working group please find below a summary of the
situation with our enforcement provisions in the UK to support 2015/2283 EU.
In the UK enforcement of food law is a devolved matter and therefore each of the
countries of the UK adopt their own enforcement provisions. The provisions in three of
the countries have been adopted and are in place:
• Scotland - http://www.legislation.gov.uk/ssi/2017/415/made
• Northern Ireland - http://www.legislation.gov.uk/nisr/2017/233/made
• Wales - http://www.legislation.gov.uk/wsi/2017/1103/made
In England the provisions have been drafted and we are awaiting a slot in parliamentary
time to put the provisions in place. A draft of the intended provisions that were subject to
consultation last summer, can be found here. The intended provisions remain the same
as this document with some minor changes to reflect working practices in enforcement
authorities. We expect that these provisions will be in place in about a month and half.
The final version will be shared when it is in place.
