Flash report - 10/8 meeting with Facebook on e-evidence

flash report from a meeting with Facebook (10/8/16) on e-
evidence.

The informal meeting took place to make Facebook aware of aware of the Commission's actions to
follow up on the 9 June 2016 Council conclusions on improving criminal justice in cyberspace and to
explore possibilities for cooperation. The Commission briefly presented the Council conclusions,
highlighting the Commission's follow-up actions with two working streams of i) more practical, short-
term activities and ii) more reflective, longer-term activities.
Facebook generally welcomed the work on e-evidence and indicated that they would be open to
contribute. Facebook referred to their existing mechanisms to facilitate the cooperation with law
enforcement authorities, including a state-of-the-art electronic portal that can be used to make requests
and follow them while they are being processed. Facebook clarified that they currently have a data
centre in Sweden, and have announced the construction of another one in Ireland. Facebook Ireland is
considered as the data controller in relation to the processing of personal data of European users.
Facebook welcomed an opportunity to have a further discussion on e-evidence with service providers in
the context of the EU Internet Forum. Facebook indicated that they will have a number of their experts
on cooperation with law enforcement visiting Brussels in the week of 15 September 2016, who may be
interested in attending the meeting of the EU Internet Forum / on e-evidence that was already
preliminarily scheduled for that day.
