Dear Ms Rojas,
I refer to your e-mail dated 2 April 2019 in which you make a request for access to
documents under Regulation (EC) N° 1049/2001 ("Regulation 1049/2001"),1 registered
on 3 April 2019 under the above mentioned reference number.
You requested access to the following document:
All documents - including but not limited to minutes, notes, audio recordings,
verbatim reports, operational conclusions, e-mails, and presentations –
produced, exchanged and related to the following meetings between Alain Paul
Lebeaupin, Apostolic Nuncio, Head of the Mission of the Holy See to the
European Union and at the time: Cecilia MALMSTRÖM, International Trade and
Trade Agreements (External Trade), 3 June 2013
However, in 2013, Ms Malmström was the Commissioner for Migration, Home Affairs
and Citizenship. She was not dealing with international trade and trade agreements,
which is the domain of DG Trade. After contacting you to clarify your request, you have
informed us that you are interested in documents related to a meeting of Mr Alain Paul
Lebeaupin with both the previous Commissioner for Trade Mr De Gucht and the present
Commissioner for Trade Ms Malmström.

After carefully checking with the respective services, we have found that a courtesy call
took place between Ms Malmström and Mr Lebeaupin on 3 June 2013. There are no
documents related to this courtesy call. No other meeting took on 3 June 2013 with either
Ms Malmström or Mr De Gucht.
We therefore regret to inform you that the Commission does not hold any documents that
would correspond to the description given in your application.
As specified in Article 2(3) of Regulation (EC) No 1049/2001, the right of access as
defined in that regulation applies only to existing documents in the possession of the
institution.
Given that no such documents, corresponding to the description given in your
application, are held by the Commission, the Commission is not in a position to fulfil
your request.

In accordance with Article 7(2) of Regulation 1049/2001, you are entitled to make a
confirmatory application requesting the Commission to review this position.
Such a confirmatory application should be addressed within 15 working days upon
receipt of this letter to the Secretary-General of the Commission at the following address:
