Your confirmatory application for access to documents under
Regulation (EC) No 1049/2001 - GESTDEM 2019/7350
Dear Ms Balanya,
I refer to your e-mail of 12 March 2020, registered on 13 March 2020, in which you
submit a confirmatory application in accordance with Article 7(2) of Regulation (EC) No
1049/2001 regarding public access to European Parliament, Council and Commission
documents1 (hereafter ‘Regulation (EC) No 1049/2001’).
Your confirmatory application was submitted in relation to your initial application of 19
December 2019 in which you requested:
‘1- all correspondence (including email) between 1st January 2019 and 19 December
2019 between the former/current Commissioner for Energy and/or his/her cabinet and/or
officials and representatives of DG Energy on one hand and representatives from Shell,
ExxonMobil and Chevron on the other, in which the European Green Deal was
addressed.
2 - list of meetings between 1st January 2019 and 19 December 2019 between officials
and representatives of DG Energy on one hand and representatives from Shell,
ExxonMobil and Chevron on the other, in which the European Green Deal reform was
addressed.
1 Official Journal L 145 of 31.5.2001, p. 43.
Commission européenne/Europese Commissie, 1049 Bruxelles/Brussel, BELGIQUE/BELGIË - Tel. +32 22991111
3 - minutes of the meetings mentioned above.’
The initial request was assigned to the Directorate-General for Energy. As you did not
receive a reply from that Directorate-General within the statutory time limits, you
submitted a confirmatory application on 12 March 2020, against the tacit refusal of
access to the documents requested.
I note that on 26 March 2020 you received the reply from the Directorate-General for
Energy, informing you that the Commission holds no documents corresponding to the
description given in your application.
Against this background, the Secretariat-General will close your confirmatory
application.
You are entitled to submit a new confirmatory application if you do not agree with the
position of the Directorate-General for Energy, included in its explicit reply of 26 March
2020.
Yours sincerely,
María Oliván Avilés
Head of Unit
