Your confirmatory application for access to documents under
Regulation (EC) No 1049/2001 - GESTDEM 2019/0064
I refer to your e-mail of 18 January 2019, registered on the same day, in which you
submitted a confirmatory application in accordance with Article 7(2) of Regulation (EC)
No 1049/2001 regarding public access to European Parliament, Council and Commission
documents2 (hereafter ‘Regulation (EC) No 1049/2001’).
SCOPE OF YOUR REQUEST
In your initial application of 7 January 2019, addressed to the Service for Foreign Policy
Instruments, you requested access to the Communication from the Commission – Rules
for the Financial Management of the Common Foreign and Security Policy Missions,
with reference C(2012)4052, version 3.
In its initial reply of 17 January 2019, the Service for Foreign Policy Instruments
informed you that it identified three documents as falling under the scope of your

the final version of the Communication, with reference C(2012)4052/F1 of 26
June 2012 (hereafter ‘document 1’), which includes the following annexes:
o Standard Financing Agreement for CFSP Missions (hereafter ‘document
o Standard Financial Rules for CFSP Missions (hereafter ‘document 1.2’).
It granted full access to documents 1.1 and 1.2, and partial access to document 13, on the
basis of the exception of Article 4(3) first subparagraph (protection of the decision-
making process) of Regulation (EC) No 1049/2001.
In your confirmatory application, you request a review of this position.
ASSESSMENT AND CONCLUSIONS UNDER REGULATION (EC) NO 1049/2001
When assessing a confirmatory application for access to documents submitted pursuant
to Regulation (EC) No 1049/2001, the Secretariat-General of the European Commission
