Dear Ms Kertysova,
We refer to your e-mail dated 19 August 2020 in which you make a request for access to
documents, registered on 20 August 2020 under the above-mentioned reference number.
You submitted an application for access to documents which covers topics falling under
the responsibility of different Commission services. In that regard, your request has been
split into two separate requests, whereby each part is attributed to the respective
Commission service under a separate Gestdem reference number. Each Directorate-
General service provides its own, separate reply which relates only to part of the scope
your application.
In particular, this reply covers the following scope: “
documents which contain the
following information:
- Intensification Sino-European talks on climate change.
- The response of the United States in this regard”
On 7 September 2020, Directorate-General for Climate Action (DG CLIMA) contacted
you to inform you that the description given in your application does not enable us to
identify concrete documents, which would correspond to your request. Consequently, we
requested you more detailed information on the documents you request in accordance
with Article 6(2) of Regulation (EC) No 1049/2001 regarding public access to
documents. A reminder was sent on 23 September 2020.

As of the day this letter is sent out, DG CLIMA have not received any reply to this
request for clarification. The reception of such a reply would have initiated the deadline
of 15 working days for handling your application in accordance with the third paragraph
of Article 2 of the detailed rules on the application of Regulation (EC) No 1049/2001.
Consequently we regret to inform you that DG CLIMA does not hold any documents that
would correspond to the description given in your application.
As specified in Article 2(3) of Regulation (EC) No 1049/2001, the right of access as
defined in that regulation applies only to existing documents in the possession of the
institution.
Given that no such documents, corresponding to the description given in your
application, are held by my service, the DG CLIMA is not in a position to fulfil your
request.
However, I would like to invite you to consult the website of the DG CLIMA dedicated
to EU-China energy relations, which provides has access to several documents
https://ec.europa.eu/clima/policies/international/cooperation/china_en
In accordance with Article 7(2) of Regulation (EC) No 1049/2001, you are entitled to make
a confirmatory application requesting the Commission to review this position.
Such a confirmatory application should be addressed within 15 working days upon receipt
of this letter to the Secretariat-General of the Commission at the following address:
