Dear Claudia, Wim and collegues,
On the 3rd of December we had a fruitful meeting on the enhanced enforcement strategy and water
quality below derogation companies. As a follow-up to this meeting, I would like to inform you about
the following:

Attached you can find two documents which give our reply to the technical questions that were
sent after our meeting on the update about the implementation of the enforcement strategy. I
hope this answers your questions in a satisfactory manner;

As discussed, in the Nitrates Committee of tomorrow the Netherlands will confirm its
commitment, should the improvement of water quality lag behind in the upcoming years, to
take additional measures to be in compliance with the Nitrates Directive (article 5.5). This is
incorporated in our presentation that Lyske has sent you earlier this week;

I would also like to inform you that yesterday evening our Senate has adopted the bill by which
the manure production ceilings are incorporated in the manure law (Meststoffenwet) and can
be maintained through the existing systems of production rights. The bill will go into force by 1
January 2020, which fulfills the agreement about this in the 6th Action Programme and
condition 14 in the derogation decision. Attached you can find the text of the adopted bill + an
amendment that is yet to be incorporated in the law. We will send you a copy of the integrated
text once it is published in the official bulletin of acts and decrees.
As discussed, it would be good to meet again in January to discuss any remaining questions and the
follow-up with regard to the derogation. Nico will take the initiative to plan a meeting.
