Dear Ms Dadci,
In your letter of 16 March, which was formally sent to our Ministry by the Ministry of Foreign
Affairs on 2 April,
you requested information on all correspondence and a list of all meetings
(including minutes) between the Permanent Representation of the Netherlands to the EU and
stakeholders regarding National Recovery and Resilience Plans and/or Recovery and Resilience
Funds up to 16 March, invoking the Government Information (Public Access) Act (
Wet
openbaarheid van bestuur; WOB).
Procedure
Receipt of your application was acknowledged in writing by letter of 29 April
, with reference no.
389. That letter also extended the time limit for taking the decision by four weeks until 27 May,
on the basis of section 6 of the WOB. In writing by letter of 26 May, you were informed that a
number of documents to which the application relates contain information obtained from or
concerning one or more third parties. On 20 May, I offered the interested parties the
opportunity to present their views on the disclosure of these documents. I set a time limit of
two weeks for this purpose, which meant that you would receive my response to your
application by no later than 10 June.

Statutory framework
Your application falls within the scope of the Government Information (Public Access) Act.
Specification of documents
In response to your application, a total of nine documents have been found. These documents
are listed in the specification enclosed with this decision as Annexe 2. For the sake of clarity,
this decision refers to individual documents based on the numbers assigned to them in the
specification.
Views of interested parties
One or more third parties whose interests may be affected by disclosure of the document(s)
numbered 1.0, 1.1, 1.2, 2.0, 2.1, 2.2, 2.3, 2.4, and 3.0 have been given the opportunity to
present their views on disclosure. The interested third parties submitted no objections to
disclosure.
Decision
I have decided to grant your application and to disclose the information you requested as
contained in documents numbered 1.0, 1.1, 1.2, 2.0, 2.1, 2.2, 2.3, 2.4, and 3.0, as far as the
information falls within the scope of this request (in documents 1.0, 1.2, 2.1 and 2.4
information that does not fall within the scope of this request will not be disclosed) and
excluding the personal data they contain. The reason for the decision to not disclose personal
data is based on the Government Information Act, section 10.2.e:

Annexe 1: Relevant article of the Government Information (Public Access) Act
Section 10
1. Disclosure of information pursuant to this Act shall not take place insofar as:
a. this might endanger the unity of the Crown;
b. this might damage the security of the State;
c. the data concerned relate to companies and manufacturing processes
and were furnished to the government in confidence by natural or legal
persons;
d. it concerns personal data within the meaning of division 2 of chapter 2
of the Personal Data Protection Act, unless the disclosure manifestly does
not constitute a breach of privacy.
2. Nor shall disclosure of information take place insofar as its importance does not
outweigh one of the following:
a. relations between the Netherlands and other states or international
organisations;
b. the economic and financial interests of the State, other bodies
constituted under public law or the administrative authorities referred to in
section 1a, (c) and (d);
c. the investigation of criminal offences and the prosecution of offenders;
d. inspection, control and oversight by administrative authorities;
e. respect for personal privacy;
f. the importance to the addressee of being the first to note the
information;
g. the prevention of disproportionate advantage or disadvantage to the
natural or legal persons concerned or to third parties.
3. Subsection 2, opening words and (e) does not apply in so far as the person
involved has consented to the disclosure.
4. Subsection 1, opening words, (c) and (d), subsection 2, opening words and (e),
and subsection 7, opening words and (a) do not apply in so far as the disclosure
concerns environmental information related to environmental emissions.
Notwithstanding subsection 1, opening words and (c) disclosure of environmental
information shall not take place if the interests of disclosure do not outweigh the
interests stated there.
5. Subsection 2, opening words and (b) applies to the disclosure of environmental
information concerning confidential procedures.
6. Subsection 2, opening words and (g) does not apply to the disclosure of
environmental information.
7. Disclosure of environmental information pursuant to this Act shall not take
place if the interests of disclosure do not outweigh the following interests:
a. the protection of the environment to which this information relates;
b. the security of companies and the prevention of sabotage.

8. If subsection 4, first sentence does not apply, the application of subsections 1, DEIZ / 21156600
2 and 7 to environmental information shall take account of whether or not the
information concerns environmental emissions.
