Dear Ms Gerbershagen,

We acknowledge receipt of your application for public access to Frontex documents.

Your application pertains to a large number of documents. Kindly indicate, in order to better serve your needs, whether you would consider narrowing it down to incident reports regarding e.g. a specific subject.

Please be informed that your application can only be registered once we could establish a commonly acceptable fair solution.

Yours sincerely,

Dear PAD,

I appreciate your response. In my estimation, there are two options that seem fair:

You could narrow the incidents down to those involving: commercial ships, merchant vessels, tug boats, supply vessels, fishing ships and fishing vessels. OR, we could agree on the release of all the listed incidents in succession.

Thanks for your help and consideration.

Yours sincerely,

Ute Gerbershagen

PAD, European Border and Coast Guard Agency

Dear Ms Gerbershagen,

Thank you for offering to split the application into individual applications. Due to the amount of incident reports, we would suggest to consider your application as 12 individual applications regarding 24 incidents each to be considered back to back, i.e. once the preceding application is concluded, the next application would be registered. The provisions of Regulation (EC) 1049/2001 would be applicable for all applications.

Kindly inform us whether this approach would suit you.

Yours sincerely,
