Access to documents data

Response to this request is long overdue. By law, under all circumstances, European Border and Coast Guard Agency should have responded by now (details). You can complain by requesting an internal review.

Dear European Border and Coast Guard Agency,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

- all data on the handling of access to documents requests by Frontex for the years 2012-2017, both inclusive. If the data for the year 2017 is currently being processed and is therefore not yet ready for publication, then the data for the years 2012-2016 should do.

I am looking specifically for a broken down version of the statistics already published in Frontex’s annual reports on public access to documents, i.e.: the background numbers to the summarized information these reports contain.

More detailed information on the application of exceptions in case of partial access or refusal would be particularly welcome.

Dear Frontex,

Many thanks for your response. I'm writing to seek a clarification on what Frontex has identified as point 3 of my request, and your response to this particular aspect.

My initial request might not have been clear enough - apologies in this regard -, but I wasn't looking for the criteria and guidelines Frontex employs when applying exceptions to access.

What I was looking for is more in the line of what Frontex has identified as point 2 in my request: "broken down version of the statistics already published in Frontex’s annual reports", i.e.: I was seeking further detail on the frequency of application of different exceptions.

The information included in Frontex's annual reports, while illustrative, does not offer percentages of application per exception. This is what I was asking for. (An example of what such a breakdown would look like can be found in the EEAS access to documents report for 2016, page 3: https://www.asktheeu.org/en/request/5103... )

To this extent, I'd like to clarify if:
a) This further detail on the application of exceptions is not held by Frontex - i.e.: the Agency has never carried out this analysis; or
b) This further detail on the application of exceptions does exist, yet Frontex is denying access to that information on the basis of Article 4 (2) second indent of Regulation 1049/2011.
