Dear Mr Teffer,

reference number. Your application is currently being handled. However, as
it concerns a large number of documents, part of which originate from
third parties which need to be consulted, we will not be in a position to
complete the handling of your application within the time limit of 15
working days, which expires on 04/09/2018.

An extended time limit is needed as your application concerns a large

However, we will not be in a position to complete the handling of your
application within the time limit of 30 working days, which expires on
25/09/2018, as the process of consulting third parties is still ongoing.

Therefore, we have to extend the time limit with 15 working days in

Dear Madam, Sir,

I refer to your message from 25 September 2018, regarding my access to documents request which was registered on 13/08/2018 under reference number GestDem 2018/4355.

You write that you will “not be in a position to complete the handling of [the] application within the time limit of 30 working days” and that therefore you have to “extend the time limit with 15 working days in accordance with Article 7(3) of Regulation (EC) No 1049/2001”.

However, that is a misinterpretation of Article 7(3) of Regulation (EC) No 1049/2001.

The article reads: “In exceptional cases, for example in the event of an application relating to a very long document or to a very large number of documents, the time-limit provided for in paragraph 1 may be extended by 15 working days, provided that the applicant is notified in advance and that detailed reasons are given.”

The legal limit is 15 working days with in exceptional cases an extension of 15 working days. It is not 30 working days with in exceptional cases an extension of 15 working days.

As you will know from Article 7(4) of Regulation (EC) No 1049/2001, “Failure by the institution to reply within the prescribed time-limit shall entitle the applicant to make a confirmatory application.”

I want to give you the opportunity to handle my application today, Wednesday 26 September. If there is no response by tomorrow morning, I will file the confirmatory application.
