Ukraine Facility?
With the Ukraine Facility, the European Union will provide predictable,
continued support to Ukraine of up to €50 billion in grants and loans for
the period 2024-2027. The Directorate General for European Neighbourhood
Policy and Enlargement Negotiations (DG NEAR) leads the work on the
implementation of the Ukraine Facility on behalf of the European
Commission.
Detailed information about the Ukraine Facility can be found in
the [1]Regulation (EU) 2024/792 of the European Parliament and of the
Council of 29 February 2024 establishing the Ukraine Facility, as well as
on the dedicated website: [2]The Ukraine Facility - European Commission
(europa.eu). For Questions and Answers on the Ukraine Facility, you can

Question 2: How do companies or individuals apply for this fund?
The Ukraine Facility is not a fund. The financial assistance under the
Ukraine Facility is structured in three pillars. The financing under the
Direct financial support to Ukraine (Pillar I) is provided directly to
Ukraine’s state budget, whereas the financing under the Ukraine Investment
Framework (Pillar II) and the Accession Assistance (Pillar III) is
implemented under indirect management, meaning that the European
Commission delegates budget execution tasks to different types of
implementing partners such as international financial institutions and
bilateral development agencies. The European Commission does not open
calls for proposals under which companies and/or individuals can submit
applications to receive funds.

Dear Europe Direct Contact Centre,
thanks for the answers, but it' still leaves me with questions.
1) Who are the "implementing partners such as international financial institutions and
bilateral development agencies" you refer to? Please provide a full list.
2) Do these partners make political decisions, like deciding who qualifies for the loans, on your behalf and why?
3) What is the money ultimately spent on? It's still our tax-money and there should be invoices or receipts publicly available, to justify the expenses.

I am filing the following confirmatory application with regards to my access to documents request 'Applications granted within the "Ukraine Facility" and other funds in support of Ukraine'.
I have not received the information I wanted. This is not the level of transparency suited for this kind of expenses. We the people have a right to know where out tax money is going, without having to turn to rumors or conspiracies. Please provide a full list of companies and organisations that make use of this facility, and for which purposes.

Dear Mr Keus,
We refer to your latest communication to the Council, dated 16 November
2024, by which you inform us that you are filing a confirmatory
application "with regards to my access to documents request 'Applications
granted within the "Ukraine Facility" and other funds in support of
Ukraine."
On 21 June 2024, you had addressed to the Council through the AsktheEU.org
platform the following questions:
“Question 1: Which EU body can provide detailed information about the
Ukraine Facility?
Question 2: How do companies or individuals apply for this fund?
Question 3: Who approves these applications?
Question 4: Please provide a list of the applications granted in this
fund.”
All four questions refer to the implementation of the Ukraine Facility
Regulation. Such implementation has been assigned to the European
Commission. In view of its content, your request was considered to be a
request for information and that it should have been addressed to the
Commission. For this reason, our services have forwarded your
communication to Europe Direct Contact Centre, which is a European
information network designated by the European Commission. You were
informed by Europe Direct Contact Centre of that transfer on 4 July 2024.
Europe Direct Contact Centre replied to you on 12 August 2024, by
providing replies to all four questions mentioned above after having
consulted the competent Commission department. You acknowledged receipt of
that reply on 9 September 2024, while asking for additional information.
If you are not satisfied with the reply provided Europe Direct or wish to
follow-up on its reply, we invite you to address yourself directly to
[1]Europe Direct.
On re-reading your request, we understand that your fourth request might
be considered as a request for access to a document. In its reply to this
fourth request, Europe Direct Contact Centre refers to its general
response to the previous questions. As explained by Europe Direct Contact
Centre, the Directorate General (of the Commission) for European
Neighbourhood Policy and Enlargement Negotiations (DG NEAR) leads the work
on the implementation of the European Facility on behalf of the European
Commission. In these circumstances, we confirm that the General
Secretariat of the Council does not hold any document covered by such
fourth request (“a list of the applications granted in this fund”).
In your latest communication dated 16 November 2024 you indicate that you
are filing a confirmatory application with the Council but referring to
the information received from Europe Direct Contact Centre (which is not
the Council). We invite you to clarify if you are entering a confirmatory
application. Such confirmatory application should only refer to the
request for access to documents on “a list of the applications granted in
this fund”. If that is the case, we invite you to explain the reasons for
contesting our reply that the General Secretariat of the Council does not
hold any such document.
We wish to further explain that your complaints as regards the
explanations concerning your request for access to information (the
questions you submitted for information) and provided to you by Europe
Direct Contact Centre cannot be the object of a confirmatory application.
