Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

The Ares registration fiche of the letters which MEP Ana Gomes sent to FVP Timmermans in July 2015, and in 2017 related to Mrs. Roelie Post, including all related correspondence in whatever form.

Dear Mr Dohle,

 

I refer to your request dated 22/08/2021, registered on 23/08/2021, in
which you make a request for access to documents under the above mentioned
reference number.  

 

Your application is currently being handled. However, we will not be in a
position to complete the handling of your application within the time
limit of 15 working days, which expires today. An extended time limit is
needed as the handling of your application could not yet be completed at
this stage.

 

Therefore, we have to extend the time limit with 15 working days in
accordance with Article 7(3) of Regulation (EC) No 1049/2001 regarding
public access to documents. The new time limit expires on 04/10/2021. I
apologise for any inconvenience this delay may cause.

Dear Secretariat General of the European Commission,

Please pass this on to the person who reviews confirmatory applications.

I am filing the following confirmatory application with regards to my access to documents request 'Ares fiche for the letters of MEP Ana Gomes'.

Hereby we oppose the extension of the time limit to 15 working days. The simplicity of this rather limited request does not allow for this exceptional measure:

'3. In exceptional cases, for example in the event of an application relating to a very long document or to a very large number of documents, the time limit provided for in paragraph 1 may be extended by 15 working days, provided that the applicant is notified in advance and that detailed reasons are given.'

Also, the subject of this request being whistle-blower protection should be a reason for urgency.
The situation gets more and more delicate! We urge you to take into account your duty of care, transparency, and accountability. In the personal interest of a civil servant, but also in the public interest of this case.

Under Article 7 (3) of Regulation 1049/2001, the time-limit in which the
Commission should handle a request for documents can be extended by 15
working days.

On 13 September 2021 you have been notified that an extended time limit
was needed as the handling of your applications could not yet be
completed.

The new time limit for handling your applications Gestdem 2021-5166 and
2021-5167 expires on 04/10/2021.

If the Commission does not reply to you within this time-limit
(4/10/2021), then you are entitled to submit a confirmatory application,
in accordance with Article 7(4) of Regulation 1049/2001.

In the meantime, we would like to assure you that we are doing our utmost
to provide you with a reply as soon as possible.
