Article 16 Staff Regulations - Fanny Pomme Langue

Dear Directorate-General Energy,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting all documentation relating to DG ENER decisions made, under Article 16 of the Staff Regulations, concerning Fanny Pomme Langue.

Specifically, I would like to receive a note of all Ms Pomme Langue's job titles whilst at DG ENER including dates held, copies of any application(s) that Ms Langue made under Article 16 of the Staff Regulations to undertake her new professional activity (at AEBIOM European Biomass Association), and all correspondence, including emails, related to the authorisation of the role.

On 24 April I have made an access to documents request for all documentation relating to DG ENER decisions made, under Article 16 of the Staff Regulations, concerning Fanny Pomme Langue. The response to my request has been delayed. By law, DG ENER should normally have responded promptly and by 15 May 2013.

I expect DG ENER to handle my request as soon as possible.

Dear Mr Melzer,

Please be informed that deadline to respond to requests for access to documents according to Regulation 1049/2001 is counted as from the date of registration of a particular request. In your case, the request was registered on 25 April 2013.

Moreover, the deadline is counted basing on working days in the European Commission. As 1, 9, 10 and 20 May are official holidays, the deadline to reply to your request lapses on 22 May 2013, of which you were informed by our e-mail of 25 April 2013 (see attached).

Dear Mr Melzer,

Referring to your request for information under Regulation 1049/2001 on the job titles incl. durations/periods for a former staff member (job title: policy officer) we can inform you that the former staff member in question was employed as a contract agent from 16/09/2009 - 15/09/2012 and did not have access to sensitive documents/information during her assignment. Therefore, and according to the provisions in place (Article 21 of the Commission Decision on outside activities and assignments) she is/was not obliged to request the explicit authorisation of the Appointing Authority (AIPN) for her to be able to accept her current employment.

NB: For two years after leaving the service, a former staff member wishing to perform outside activities or assignments must inform the Appointing Authority. This also applies to contract staff who have had access to sensitive information (Article 21 of the Commission Decision on outside activities and assignments).
