Artificial intelligence in the European Union

Response to this request is long overdue. By law, under all circumstances, European Council should have responded by now (details). You can complain by requesting an internal review.

Dear European Council,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
documents that cover how artificial intelligence (AI) is seen, understood, and intended to be used by the European Union

I am a student in Braga (Portugal) doing a project for a PhD thesis in artificial intelligence.

I would like to understand how the European Union and member states see artificial intelligence, which countries have more significant restrictions against the use of AI, how the EU sees AI on the issue of security, defense, and cooperation with the US and UK, and if there is any EU foreign policy, now or in the future in this regard.
I would also like to know if EU institutions and bodies such as EUROPOL, INTCEN, European External Action Service, CERT-EU, eu-LISA, ENISA, EMSA, Eurojust, EUSPA, Frontex, European Defense Agency, SatCen, European Committee for Data Protection, the European Data Protection Authority and the European Union Institute for Security Studies take into account the issue of artificial intelligence, whether AI is relevant to its operation and whether for the institution/body presented here, AI is used as a means of cooperation.

Thank you for your requests addressed to the Council of the European Union
and to the European Council and your interest in having access to Council
documents.

 

The fact that you have not indicated specific document’s reference number
makes it difficult for us to conduct an accurate search aimed at
identifying the exact documents you are looking for.

 

In this context, the General Secretariat of the Council would like to
inform you that access to documents of the Council is subject to the
principles, conditions and limits laid down in Regulation (EC) No
1049/2001 (OJ L 145, 31.5.2001, p. 43) and the specific provisions laid
down in the Council's rules of procedure (OJ L 325, 11.12.2009, p. 35).

 

In general, rules on access to documents establish that the public can
have direct access to documents of the Council when these documents were
issued as public documents or have been made public as a result of a
previous request for access.

 

If a document is not public, a member of the public can put forward a
request for access. However, the General Secretariat of the Council would
like to draw your attention that Regulation 1049/2001 does not foresee a
right of privileged access.

 

This means that when there is a request for access to documents, the
General Secretariat of the Council has to examine each individual document
requested to see if its disclosure to the public would harm any of the
interests protected under the Regulation. Following that examination, the
General Secretariat may decide to refuse access, or agree to the partial
or full disclosure of the requested document. In case of the latter, the
document is then made available to the public through the Council's Public
Register.

 

In view of the above, the General Secretariat strongly advises applicants
for access to documents to narrow down, to the extent possible, their
request’s scope. To help you further define your query, may we suggest
that you conduct a search within the Council's public register at
[1]http://register.consilium.europa.eu/ ?

 

By choosing the option "Search in the register", you can search for
documents using several criteria, for example: document number, words in
title or text, subject matter and interinstitutional file number.

For instance, if you indicate Artificial intelligence in the field ‘words
in subject’, you will get a list of 91 documents – most of them are public
and directly available.

 

Should you find a document in the register which interests you and which
cannot be directly downloaded,  you may introduce a request for access by
using the available electronic form.

 

We hope that this information would assist you in your search for Council
documents.

 

In the light of the above, your requests were not registered.

 

As to your question whether EU institutions and bodies such as EUROPOL,
INTCEN, European External Action Service, CERT-EU, eu-LISA, ENISA, EMSA,
Eurojust, EUSPA, Frontex, European Defence Agency, SatCen, European
Committee for Data Protection, the European Data Protection Authority and
the European Union Institute for Security Studies take into account the
issue of artificial intelligence, the Secretariat of the Council is not
able to reply.  We advise you to address your request directly to them.
