Dear Mr Teffer,
We refer to your application dated 12/10/2018 in which you make a request for access to documents, registered under the above mentioned reference number.
Your application is currently being handled. However, we will not be in a position to complete the handling of your application within the time limit of 15 working days, which expires today, 6/11/2018.
An extended time limit is needed in order to finalise the inter-service consultations in relation to the requested document. I am filing the following confirmatory application with regards to my access to documents request registered on 12/10/2018 under reference number GestDem 2018/5395.
British American Tobacco is a tobacco company. The European Union is a party to the WHO Framework Convention on Tobacco Control. According to the Guidelines for implementation of Article 5.3 of the WHO Framework Convention on Tobacco Control, parties “should ensure that any interaction with the tobacco industry on matters related to tobacco control or public health is accountable and transparent”.
Additionally, the guidelines say: “Where interactions with the tobacco industry are necessary, Parties should ensure that such interactions are conducted transparently. Whenever possible, interactions should be conducted in public, for example through public hearings, public notice of interactions, disclosure of records of such interactions to the public.”
In light of the above, one would expect that the Commission had produced a more elaborate record of the meeting between the Member of Cabinet Hahn and representatives of the British American Tobacco, than the four-line email.
When it comes to the redacted parts, the public interest of transparency on dealings with tobacco companies – as agreed to in the WHO Framework Convention on Tobacco Control – may weigh heavier than the exceptions cited.

I regret to have to inform you that we will not be able to respond within
the extended time limit, as we have not yet finalised internal
consultations. However, I can assure you that we are doing our utmost to
provide you with a final reply as soon as possible.
