British or EU Citizen?

Dear Council of the EU,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

Now that the UK Referendum has been decided and the UK have voted to leave the EU, what happens to those UK citizens that want to remain as an EU national?
I understand that until Article 50 has been enacted the UK is still a part of the EU, but what about after the two year period as described in the Lisbon Treaty?

Will the citizens of the UK be able to choose on a one-to-one basis whether or not they want to be stripped of their EU national status or do they not get that option?

Dear Ms Perry,

Thank you for your message to the general secretariat of the Council of the EU.

It should be noted that the UK is still a fully-fledged member of the European Union. According to Article 50(2) TUE a Member State which decides to withdraw from the Union shall notify the European Council of its intention. Till such a notification is made, the Member State remains a full member of the Union, enjoying all the rights and bound by all obligations stemming from the Treaties, including the principle of sincere cooperation. Hence, the rights and obligations of the EU citizens living in the UK, and of the UK citizens living in other Member States, have not changed .

According to the Treaties the citizenship of the Union is additional to, and does not replace, national citizenships. This means that the European citizenship ensues from the fact of being national of one of the Member States and cannot be conferred on citizens of third States.

Following the notification, and in the light of the guidelines provided by the European Council, the Union will negotiate and conclude an agreement with the withdrawing Member State setting out the arrangements for its withdrawal.
