Certification under CS-22 of the JS1 Jonkers Sailplane

The request was refused by European Aviation Safety Agency.

Dear European Aviation Safety Agency,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

Any and all information related to the attempted EASA CS-22 certification by M&D Flugzeugbau GMBH of a South African sailplane based on the Jonkers JS1.

No commercially sensitive information is being requested. What is sought are documents to enable understanding of where M&D is in the certification process and the basis for current delays.

EASA denied the request referring to EC Rgulation 1049/2001 Articles 2 and 3:

Art 2 : The institutions shall refuse access to a document where disclosure would undermine the protection of:
---commercial interests of a natural or legal person, including
intellectual property,
(…)
Art 3 : Access to a document, drawn up by an institution for
internal use or received by an institution, which relates to a
matter where the decision has not been taken by the institu-
tion, shall be refused if disclosure of the document would
seriously undermine the institution's decision-making process,
(...)

Apparently the Agency fears that disclosure will both undermine M&D's commercial interests and the Agency's decision-making ability.
