Regulation 1049/2001 clearly states that a request should be handled within 15 working days, and that an extension of another 15 working days is only allowed "[in] exceptional cases". There is no legal basis for taking a third period of 15 working days to comply with the request.

As you will be aware, the regulation gives the applicant the entitlement to make a confirmatory application if the institution fails to reply within the prescribed time-limit. If a reply has not been sent by Wednesday 5 December, this is what I will do.

I refer to my access to documents request registered on 15/10/2018 under reference number GestDem 2018/5412. You have taken two periods of 15 working days and have now announced the need for a third period of 15 working days. This is unacceptable.

Regulation 1049/2001 clearly states that a request should be handled within 15 working days, and that an extension of another 15 working days is only allowed "[in] exceptional cases". There is no legal basis for taking a third period of 15 working days to comply with the request.

The European Commission has taken two periods of 15 working days and on 29 November announced the need for a third period of 15 working days to reply. This is unacceptable.

Regulation 1049/2001 clearly states that a request should be handled within 15 working days, and that an extension of another 15 working days is only allowed "[in] exceptional cases". There is no legal basis for taking a third period of 15 working days to comply with the request.

I urge the secretariat-general to facilitate a quick handling of my request.
