Comments of the EDPS on the COM proposal for a revision of the 4th anti-money laundering directive

Response to this request is long overdue. By law, under all circumstances, European Data Protection Supervisor should have responded by now (details). You can complain by requesting an internal review.

thank you for your answer.

However, I would like to ask you to clarify why you have not been able to find any document corresponding to my request although the European Commission in its proposal for a Directive of the European Parliament and of the Council amending Directive (EU) 2015/849 on the prevention of the use of the financial system for the purposes of money laundering or terrorist financing and amending Directive 2009/101/EC (COM(2016) 450 final) states in recital 42 "The European Data Protection Supervisor was consulted in accordance with Article 28(2) of Regulation (EC) No 45/2001 of the European Parliament and of the Council [and delivered an opinion on …]".

Can you confirm that you have not been consulted by the European Commission on its proposal for a revision of the 4th anti-money laundering directive?

Thank you for your reply.

 

To begin with, the recital you are quoting (no. 42) is part of many
legislative texts we receive. This sentence is included in templates, but
does not necessarily means that we have been consulted, also due to the
fact that we do not "deliver an opinion" on every legislative text.

 

In this particular case the EDPS received the text of document COM
2016/450 after its publication on EUR-Lex. No legislative text was
transmitted to us earlier. Therefore, we do not have any documents that
includes our views or opinion on COM 2016/450, simply because they were
not requested.
