Commission plans for ensuring compliance with services notification obligation

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

- the Commission's plans for implementing "steps to ensure that Member States comply with the existing notification obligation under the Services Directive in order to identify and eliminate new potential regulatory barriers". Such steps were announced in the Single Market Enforcement Action Plan (SMEAP) presented in March 2020 (Action 11).

"ACTION 11: Preventing new barriers to providing services in the single market
To prevent unjustified barriers in the services single market, the Commission invites the European Parliament and Council to proceed with a speedy adoption of the legislative proposal for a new Services Notifications Directive. Pending the adoption of the proposal, the Commission will take steps to ensure that Member States comply with the existing notification obligation under the Services Directive in order to identify and eliminate new potential regulatory barriers."

There is no further information in the public domain on what kind of steps the Commission intends to take, which means public scrutiny and informed debate is virtually impossible. There is therefore a clear public interest in the release of the requested documents.

This response is at odds with your obligation to be as transparent as possible about the functioning of EU decision-making.

When the Commission in its March 2020 Single Market Enforcement Action Plan (SMEAP) announced "steps to ensure that Member States comply with the existing notification obligation under the Services Directive in order to identify and eliminate new potential regulatory barriers", the Commission must also have developed documents that contain more information about what these steps are, in other words the Commission's concrete plans for implementing this announcement.

After having clarified what kinds of documents are covered by my request, I would request that you do a new search of the Commission's archives and release the relevant documents.

As mentioned in my access to documents request, there is no further information in the public domain on what kind of steps the Commission intends to take, which means public scrutiny and informed debate is virtually impossible. There is therefore a clear public interest in the release of the requested documents.

you submit confirmatory application in accordance with Article 7(2) of
Regulation (EC) No 1049/2001 regarding public access to European
Parliament, Council and Commission documents (‘Regulation 1049/2001’).

 

We have finalized the assessment of your confirmatory application. The
reply is awaiting for the signature of the Secretary-General. Therefore,
we are not in a position to reply to your confirmatory requests within the
prescribed time limit which expires on 27 May 2020.

 

Consequently, we have to extend this period by another 15 working days in
accordance with Article 8(2) of Regulation (EC) No 1049/2001. The new
deadline expires on 18 June 2020.

 

I regret this additional delay and sincerely apologise for any
inconvenience this may cause.
