Commission responses to stakeholders regarding new Formentera Island Council rules for tourist accommodation

Dear Internal Market, Industry, Entrepreneurship and SMEs,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

- the European Commission's responses to stakeholders who commented on Services Directive Notification (IMI report No 92633.1, concerning Draft Regulation No 1/2019 of the Formentera Island Council).

The back ground for this FOI request is a previous request submitted earlier this year for "all comments provided to the Commission by stakeholders concerning incoming notifications regarding services” (request for access to documents GESTDEM No. 2020/1908).

This resulted in the release of three documents, including:
- A letter from the European Holiday Home Association(EHHA), sent on 10 February 2020 (registered by the Commission in the context of the FOI request as Ref. Ares(2020)2245669 - 27/04/2020)), commenting on the Spanish government's Services Directive Notification (IMI report No 92633.1) on “Draft Regulation No 1/2019 of the Formentera Island Council regulating the marketing of tourist accommodation in residential dwellings”
- A letter from Deutscher Ferienhausverband, sent 4 February 2020 (registered by the Commission in the context of the FOI request as Ref. Ares(2020)2245669 - 27/04/2020)), commenting on the Spanish government's Services Directive Notification (IMI report No 92633.1) on “Draft Regulation No 1/2019 of the Formentera Island Council regulating the marketing of tourist accommodation in residential dwellings”

In their letters, EHHA and DFV state that they consider the new rules to be "excessive and restrictive measures to short-term rentals, part of a "trend to impose discriminatory, unjustified, unproportionate and unsuitable measures to short term rentals in the Balearic Islands".

We are requesting access to the Commission's responses to EHHA and DFV on these issues, in order to better understand the European Commission's new mechanism allowing stakeholders to comment on Services Directive Notifications.
