Communication with AGA

Dear Communications Networks, Content and Technology,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

At the end of October 2016, Commissioner Günther Oettinger was invited speak at the "EuropaAbend", an event organised by the AGA (AGA Norddeutscher Unternehmensverband Großhandel, Außenhandel, Dienstleistung e. V.). In a Access to Documents request, the Commission was unable to provide communication between the Commission and the AGA related to this event, except for a letter sent by AGA on December 1st to Commissioner Oettinger (https://www.asktheeu.org/en/request/27_e...).

In this letter (Ref. Ares (2016) 7049904 - 19/12/2016), the AGA representative explains the optimal collaboration between the AGA and the staff of Commissioner Oettinger to prepare and conduct the event. Two people are referenced by name for outstanding work; one name is redacted by the Commission, the other is Michael Hager.

I am requesting all information (including emails, drafts, memos, notes, recordings, tables, files, etc)

c) from Günther Oettinger, Michael Hager and the person whose name is redacted

that relates to the Hamburg event. The temporal scope of this requests should contain both the time before as well as after the event. The request both refers to information sent to the AGA and their representatives as well as information that Mr. Hager and his redacted colleague sent to other people, both outside as well as inside the Commission.

Since the AGA representative explicitly lauds the "close contact" to the person whose name is redacted and notes the "very good collaboration" in the aftermath of the event, it is highly plausible that much more information exists than was previously disclosed in the above mentioned access to documents request.

I also request a copy of the data on the USB drive that was sent to Commissioner Oettinger by the AGA.

thank you for your letter in which you are explaining the reason for seeking an extension of the deadline for the confirmatory application by another 15 days.

In your words, this extension is needed because the Secretariat General of the European Commission was unable to establish contact with the DG CNECT. While this breakdown of communication might be tragic (and frankly, very worrying), it does not qualify for an extension of the deadline required by Regulation 1049/2001.

Article 8 (2) of Regulation 1049/2001 allows your institution to extend the deadline by 15 working days "in exceptional cases". This is an open ended wording to cover events that could not be anticipated or to handle cases that require work beyond what is usually required to handle access to information requests. The information you provide does not concern the case but rather the institution handling it. DG CNECT's failure to reply does not render this case exceptional. In the absence of other reasons provided, the requirements for an extension of the deadline are not met.
