Dear Ms Fiedler,

We refer to your access to documents application received on 14/02/2019
and registered on the same date under the above mentioned reference
number.

The identification of documents takes more time than expected since the
European Commission is in principle not directly involved in direct
communication with Member States’ national regulatory authorities for the
preparation of the implementation report of the Open Internet Regulation.
All exchanges go through the Body of European Regulators for Electronic
Communications (BEREC). The Commission only has a limited role in this.

We identified some documents at a late stage and for each of these
documents, a thorough assessment must be undertaken pursuant to Regulation
1049/2001.

Dear Communications Networks, Content and Technology,

Please pass this on to the person who reviews confirmatory applications.

I am filing the following confirmatory application with regards to my access to documents request 'Communications with Member States on the Open Internet Regulation implementation'.

First of all, point (i) of your letter dated 23 April 2019 will no longer be applicable once the report has been published by the European Commission. I therefore request a review of the decision and the release of the requested documents after 30 April 2019.

Secondly, regarding point (ii) of your letter, I understand the necessity to protect the privacy of individuals involved. However, and as per my initial request, I would like to receive the requested documents as I would like to ask for access only to anonymised communications and documents where personally identifiable information has been redacted.

A full history of my request and all correspondence is available on the Internet at this address: https://www.asktheeu.org/en/request/comm...
