Dear Mr. McClure,

We refer to your e-mail dated 10/10/2012 in which you make a request for
access to documents under Reg. (EC) 1049/2001, registered on 12/10/2012
under the above mentioned reference number.

I would like to inform you that the majority of the requested documents
(155 of 173 contributions) are available in the website Europa at the
following address:

Ref. Gestdem 2012/4680 - Green Paper on promotion measures and information
provision for agricultural product:

[1]http://ec.europa.eu/agriculture/promotio...

For the other 18 contributions, the contributors have not given their
consent even for anonymised publication. For this reason and in accordance
with Article 4(4) 4(5) of Regulation 1049/2001

we have to proceed to consultations with the Member States and other third
parties concerned. As soon as the consultations finish we will inform you
of the result.

Dear Mr. McClure,

Further to my e-mail of 12th October 2012, I would like to inform you that
your application is currently being handled. However, we will not be in a
position to complete the handling of your application within the time
limit of 15 working days.

After having received the feedback from the responsible units of DG AGRI
that treat your requests, I confirm that the handling of your requests
will take several months and an extended time limit is needed but it's not
possible to fix a specific deadline for the following reasons:

- Your application concerns a very large number of documents. Apart the
published documents that you have already received, there are
approximately 1364 documents which need to be assessed individually. Such
a detailed analysis brings an excessive workload that cannot be carried
out within the normal time limits set out in Article 7 of Regulation
1049/2001. The handling of your request involves the assessment of very
voluminous documents originating from third parties and several Member
States. The analysis of these documents, together with the need to make
around 200 consultations with the third parties and Member States
concerned, in accordance with Article 4(4) 4(5) of Regulation 1049/2001,
cannot be expected to be completed within the normal time limits set out
in Article 7 of Regulation 1049/2001.

For many of these documents, the Commission has committed to keep some of
the information confidential and has to contact each Member State, region,
NGO, citizen and other bodies, to request the permission to disclose their
documents.  Please note that it will not be possible to get in contact
with all of them because some of the contributions lack contact details.

Moreover, even if the Commission obtains the permission, a large number of
the contributions will have to be anonymised because of the commitment of
the Commission to protect the privacy and the integrity of the individual,
in accordance with Community legislation regarding the protection of
personal data. This means that all references to the contributor's
identity will be removed in many documents.

- In order to retrieve the documents requested, large files have to be
examined as well as older and actual databases of the Commission.

- Please note that for the request no Gestdem 2012/4684,The Future of the
"Most Deprived Persons Food Distribution" Programme there were 12.000
replies received to the on-line questionnaire for which we asked the help
of the computing service on the possibility of retrieving these data.

However, the Regulation also provides for a possibility to confer with
applicants in order to find a fair solution when an application concerns a
very large number of documents. Article 6(3) provides that "in the event
of an application relating to a very long document or to very large number
of documents, the institution concerned may confer with the applicant
informally, with a view to finding a fair solution".

Based on this provision, we would kindly ask you whether you could narrow
down the scope of your request, so as to reduce it to a more manageable
amount of documents. If that is not possible and if you maintain your
request for access to all documents concerned by your application, we
propose to handle your application in successive stages. If you accept
this proposal, you could indicate an order of priority, which we will
follow as much as possible in handling your application. If necessary, I
will inform you separately for the progress of each request. You will
receive, at regular intervals and separately for each request, batches of
documents which have been cleared for release or a reasoned reply
explaining why some documents cannot be disclosed.

If you are searching for specific information, please let us know, in
order to try to find if there is a different way to get this information.
We could also try to organise a meeting or a videoconference to discuss
your requests.

If you have any questions concerning this proposal, you can contact us:

•           by e-mail to: [1][email address]

•           by telephone to: (+32) (0) 22 95 98 94

Thank you in advance for your understanding.

Dear Mr. McClure,

Thank you for your e-mail confirming that you have received my e-mail of
31st October. Could you please give me your reply as soon as possible in
order to find a solution for the treatment of your requests?

I would also like to forward to you an e-mail of the unit G.1 of DG AGRI
which is responsible for your request No Gestdem: 2012-4683 - Review of
the Less favoured Area Scheme:

"Dear Mr. McClure,

Thank you for your request as regards the LFA review.

In order to meet this request in the most satisfactory and efficient
manner, we would like to explain the procedure and seek your further
guidance.

1) We received more than 100 contributions in the consultation. These
contributions were provided in different EU languages.

2)  The Commission has committed itself to keep some of the information
confidential. The following statement featured in the Cover Note of the
consultation:

The results of the consultation will be reflected in the steering group's
report, which is due to be published in summer 2008. A summary of the
results will be published on this website. The information given will
remain confidential in line with Regulation 45/2001 and will not be
transferred to anybody. We guarantee that the answers will be anonymised.

Therefore, in order to provide the contributions to the review, the
Commission services will have to go back to each Member State, region,
NGO, citizen and other bodies who contributed to the review, and request
their permission to share their contribution with you.  It is presently
unknown to us what feedback we may receive, however, I wish to draw your
attention to the fact that some of the contributions lack contact details
and it will not be possible for us to get in contact with all
contributors.

3) In case the Commission services could obtain the permission, the
contributions will have to be anonymised. This means that all references
to the contributor's identity will be removed. Apart from the fact that
this will take several months, the contributions will not reveal their
content in their entirety.

Therefore, we would be most grateful if you could further define your
request.  Are you looking for a specific piece of information? If so,
perhaps we could choose a different working method so that we could meet
your expectations. We could also try to schedule a meeting or a
videoconference etc. with the colleagues responsible for the LFA review to
discuss your request."

Could you please take into consideration both my e-mail of 31st October
that covers all your requests as well as the e-mail of today of G.1 before
giving us your reply?

Dear Agriculture and Rural Development (AGRI),

I would like to continue my pursuit of these documents. These documents include a systematic format:

1. The preliminary document (from the EU bodies)
2. The opinions (or consults) received for the document during the consultant period. However, you may bypass those documents that are NOT in English. I will not be utilizing these.
3. The final document (from the EU bodies) that was officially released after the EU body took the third-party opinions into consideration.

You can find an example of this here:
http://ec.europa.eu/health/scientific_co...

The difference is that I want copies of the original consultation documents.

My dominant issue is that these have not been made public, or even discussed, though these are all public documents.

I will still continue by pursuit, but due to the volume of the request, I understand that this process may be slowed, in stages, etc.

Yours faithfully,

Christopher McClure

Dear Mr McClure

As we already informed you in previous correspondence, many of the
documents you requested are third parties documents and for this reason
the Commission has to consult the authors in order to request their
permission to disclose the documents.

One of the organisations we consulted, Pan Europe from Belgium that agrees
to disclose its document, asked to know which is your identity. Could you
please indicate, as soon as possible, whether or not you agree to inform
this organisation on your identity? If your reply is positive, could it
apply to other similar requests we may receive?

Thank you in advance for your cooperation,

Dear Mr McClure,

For some of the requests with the above mentioned numbers, the number of
the documents is very big and cannot be sent by e-mail (the volume exceeds
the capacity of the system). For this reason we will burn the documents in
a CD.

Could you please give us your mailing address where we can send you the
CDs?

Dear Mr McClure,

In my e-mail of 4^th December 2012, I asked for your opinion on whether we
can disclose your identity to one of the organisations we consulted. As
already mentionned, "Pan Europe" agreed to disclose its document but asked
to know which is your identity. Unfortunately we haven't received a reply
from your part yet.

Today, we received a positive reply from another organisation "Euroban"
which asked from whom the application comes from. They also mentioned in
their e-mail that form 2006 there have been significant developments since
today and they would be eager to share this with you if possible.

Could you please indicate, as soon as possible, whether or not you agree
to inform these organisations on your identity? If your reply is positive,
could it apply to other similar requests we may receive in the future?

Thank you in advance for your cooperation,

Best regards,
