Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

1. Communication in the form of documents (agendas, meetings, minutes of meetings, lists of participants, etc.) between DG CLIMA and interest groups, as defined in the Transparency Register, regarding biofuels in relation to Directive 2015/1513.

2. Communication in the form of e-mail exchanges between Commissioner Connie HEDEGAARD and her cabinet and interest groups, as defined in the Transparency Register, regarding biofuels in relation to Directive 2015/1513.

The timeframe for my request is between 30/07/2010 and 17/10/2012.

I would prefer these items on a rolling basis, rather than waiting until the full response is ready.

Dear Mr Gilotto,
 
We refer to your e-mails dated 4 and 10 April 2017 in which you make a
request for access to documents, registered on 12 April 2017 under the
above-mentioned reference number.
 
The preliminary search result, based on the timeframe and stakeholders
indicated in your application, has revealed a considerable number of
documents, some 200, that are potentially within the scope of your
request. These documents need to be assessed individually in order to
identify those that are in relation to Directive (EU) 2015/1513, the
subject of your request. This individual assessment together with the need
to consult the third parties concerned in accordance with Article 4(4) of
Regulation 1049/2001 cannot be expected to be completed within the normal
time limits set out in Article 7 of this Regulation.
 
However, Article 6(3) of the Regulation also provides for a possibility to
confer with the applicant in order to find a fair solution when an
application relates to possibly very large number of documents. Based on
the afore-mentioned provision, we therefore ask that you consider the
following suggestions:
 

 1. To narrow down the scope of your request, i.e. the number of
stakeholders and/or timeframe covered, so as to reduce it to a more
manageable number of documents.

 

 2. If that is not possible and if you maintain your request for access to
all documents concerned by your application, we propose to handle your
application in successive stages. You would in that case receive, at
regular intervals, batches of documents which have been cleared for
full or partial release and/or a reasoned reply explaining why some
(parts of the) documents cannot be disclosed.

According to our estimates, the handling of your request would take some
34 working days, broken down as follows:

* identification, retrieval, assessment of scope (subject), listing:
0.5h per document, amounting to 12.5 days
* double-check of final document list: 1 day
* third party consultation in accordance with Article 4(4): 4 days
preparation/dispatch/follow-up + 5 days deadline
* redaction of those parts of the documents to which one or several
exceptions apply: 4 days
* preparation of draft reply taking account of third party arguments: 2
days
* consultation of relevant services regarding draft reply: 3 days
* approval by Director General and dispatch of final reply: 2 days

 
In order to enable us to respect the time-limits of Regulation 1049/2001,
we would ask you for a swift reply to our invitation to propose a fair
solution, within five working days at the latest:

In this case, I would suggest that the number of stakeholders be reduced to the following: FuelsEurope, Finnish Petroleum and Biofuels Association, BP Biofuels, Shell, Neste, Transport and Environment, and the European Biodiesel Board.
