Thank you for your below message dated 10 September 2024. We hereby
acknowledge receipt of your application for access to documents under
Regulation (EC) No 1049/2001 (ATD Regulation), which has been registered
on 16 September 2024 under reference ATD-110-2024.
 
As you clarified and broadened the scope of your request compared to the
scope of ATD-092-2024, ECHA decided to handle it as a new request. With
this, you will have another option to submit a confirmatory application in
case you are of the opinion that ECHA did not address your request
properly.
 
In addition, we would like to further clarify the scope of your request.
You requested all correspondence related to the ECHA/TA/2024/003 call’s
written test, dated between 1 August and 23 August 2024. In specific,
“referring to both internal and external communication (minutes of
meetings, e-mails, etc.). Specifically focusing on your decision-making
process, that has led to the decision so that all invited candidates had
to redo the written test, regardless, whether they wanted to or not.”
 
We would like to point out that Article 6 of Annex III to the Staff
Regulations which specifically lays down the procedure for competitions,
provides that ‘[t]he proceedings of the Selection Board shall be secret’.
According to the current practice of the Court of Justice of the European
Union “secrecy was introduced with a view to guaranteeing the independence
of Selection Boards and the objectivity of their proceedings, by
protecting them from all external interference and pressures whether these
come from the Community administration itself or the candidates concerned
or third parties.” This principle of secrecy covers all emails and meeting
minutes of the Selection Board members.
 
Further to this, we would like to highlight that ECHA is committed to
treating requests under the ATD Regulation within the shortest timeframe
possible. However, in our opinion according to your request, “all
correspondence” would include all emails and attachments ECHA received
from the applicants as well. This concerns a high number of emails
(approximately 400) and over 200 attachments originating from third
parties, which need to be assessed individually.
 
Such a detailed analysis, together with the need to consult the third
parties concerned in accordance with Article 4(4) of the ATD Regulation,
cannot be carried out within the normal time limits set out in Article 7
of ATD Regulation.
 
Article 6(3) of the ATD Regulation provides that in the event of an
application relating to a very long document or to very large number of
documents, the institution concerned may confer with the applicant
informally, with a view to finding a fair solution.
 
Therefore, we propose the following options as fair solution:
 
1.      Keeping the original scope including all documents and emails
received from third parties - expected processing time would be around
three months.
2.      Focusing on internal documents, correspondence and regarding the
external ones keeping only the ones that originate from ECHA - expected
processing time is within the normal time limits set out in Article 7 of
the ATD Regulation.
 
Therefore, in accordance with Article 6(2) of Regulation (EC) No
1049/2001, we kindly ask you to clarify the scope of your request by
providing us with more detailed information on the documents which you
seek to obtain or indicating which option proposed above would be your
preference.
 
Please note that, as set out in the Management Board decision on the
implementation of Regulation (EC) No 1049/2001 in ECHA (MB/12/2008 final),
the deadline for replying to your request will run only from the time we
have received your clarification.
 
We would appreciate receiving the clarification of your application by 03
October 2024.
 
If we do not hear from you within the above timeframe, your request will
be closed, and it will not be further processed.
