Correspondence relating to Robert McCoy harassment claims

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

From 2003-2004, all correspondence between then Secretary Generals Vincenzo Falcone and Gerhard Stahl on the one hand, and members of the CONT committee (COCOBU) and/or OLAF on the other, relating to the case of CoR financial controller/internal auditor Robert McCoy, who had claimed harassment by the CoR.

Dear Committee of the Regions,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Committee of the Regions' handling of my FOI request 'Correspondence relating to Robert McCoy harassment claims'.

Your decision to deny me these documents can have no legal basis. Both the fraud allegations and the harassment of the whistle-blower have been decisively established by each and every controlling authority which has been called upon to look into the case. There simply cannot be any justification for hiding behind art 4(2) of the FOI Regulation.

Furthermore, I would argue that in light of two EU court judgements on this matter and ongoing resolutions by the European Parliament, there is an unanswerable case for this documentation to be released in the public interest. I intend to fight for the release of these documents for as long as it takes.
