Dear European Chemicals Agency,

Under the right of access to documents in the EU treaties, as developed in the access to documents Regulation 1049/2001 and Aarhus Regulation 1367/2006, I am requesting documents which contain the following information:

Correspondence, including emails, sent or received by officials working on the assessment of FORMALDEHYDE with ANSES (The French Agency for Food, Environmental and Occupational Health & Safety). This includes inter-institutional correspondence, correspondence with Member States’ authorities and their Permanent Representations as well as correspondence with third parties.

Thank you for your request for access to documents dated 13 March 2019 and
registered on 14 March 2019 under the above-mentioned reference number.

 

In your request you seek access to “correspondence, including emails, sent
or received by officials working on the assessment of FORMALDEHYDE with
ANSES (The French Agency for Food, Environmental and Occupational Health &
Safety). This includes inter-institutional correspondence, correspondence
with Member States’ authorities and their Permanent Representations as
well as correspondence with third parties.”

 

However, in order to process your request and in accordance with Article
6(2) of Regulation (EC) No 1049/2001 regarding public access to documents,
we invite you to provide us with more detailed information on the
documents which you would like to have access to, namely:

 

-      The type of assessment to which your refer, including the
indication of the relevant specific regulatory process(es) (REACH, CLP
and/or BPR).

-      The precise indication of the institutions you refer to by
mentioning “inter-institutional correspondence”, in particular, whether
you refer only to correspondence with ANSES or also with other Member
States’ Competent Authorities?

 

Please note that, as set in the Management Board decision on the
implementation of Regulation (EC) No 1049/2001 in ECHA ([1]MB/12/2008
final), the deadline for replying to your request shall run only from the
time we have received your clarification. We would appreciate to receive
it until 3 April 2019. If you do not contact us within this timeframe,
your request will be considered as closed and it will not be further
processed.
