Data on migrant returns

Dear Secretariat General of the European Commission,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

-how many third-country nationals have been ordered to leave Europe in 2017 and 2018, per year and per month;

-the total number of return operations organised by each EU Member States in 2017 and 2018, per year and per month, and the total number of migrants returned with these operations in 2017 and 2018, per year and per month;

-the total costs of returning migrants from Europe to third countries in 2017 and 2018;

-a list of the bilateral, return and readmission agreements (which kind, with which country, date of their conclusion) Europe has to return migrants to third countries.

In addition, I request the reports the Commission has to send every three years to the European Parliament and the Council on the application of Directive 2008/115/EC (Directive on common standards and procedures in Member States for returning illegally staying third-country nationals). I would like to know on which sources the Commission has based these reports, and whether Member States have an obligation to report to the European Commission or to other European bodies on the return operations they are conducting. In case they do, I would appreciate if you could provide me with these reports from 2014 onwards.

Although I do appreciate your suggestion, I would like my application to be treated as a request for access to documents, as developed in Regulation 1049/2001 of 30 May 2001 regarding public access to European Parliament, Council and Commission documents.

I am indeed interested to know whether the Commission holds any document containing the information I am looking for. At the same time, in my application I had requested access to the reports the Commission has to send every three years to the European Parliament and the Council on the application of Directive 2008/115/EC (Directive on common standards and procedures in Member States for returning illegally staying third-country nationals). I don't see how this request could be treated as an access to information one.

Please also note that Regulation 1049/2001 applies to information recorded in any format ("any content whatever its medium"), so data contained inside electronic system also falls within the definition of documents for the purposes of the regulation.

I would be grateful if you could reply at your soonest convenience to confirm that my application will be treated as an access to documents request and that you will respect the original timeframe (you acknowledged receipt of the request on 16 August 2019). Hence a reply should be provided within a maximum of 15 working days from the date of receipt of the request.
