Data on Western Balkans Investment Framework (WBIF) disbursements

Response to this request is long overdue. By law, under all circumstances, European Investment Bank should have responded by now (details). You can complain by requesting an internal review.

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain data on on funds the EIB has allocated to the Western Balkans Investment Framework.

This should include: details regarding the suppliers commissioned by the beneficiary countries with the implementation of the projects; the amounts committed and disbursed to each supplier; and tender/contract references where available.

I request that you send me the information in a spreadsheet format.

I would like to remind you that the regulation requires you to confirm the receipt of my request immediately, and provide the requested documents within 15 working days from today.

We refer to your message of 08 September 2020 addressed to the European
Investment Bank (EIB) via the AsktheEU.org website requesting data on the
Western Balkans Investment Framework (WBIF).  We also refer to our message
of the same date, extending the timeline to reply to your request. Your
request has been handled in line with the provisions of the EIB Group
Transparency Policy (EIB-TP) [1], which applies to such requests addressed
to the EIB.

 

With regard to the first paragraph of your request, the EIB would like to
clarify that the WBIF is a blending instrument whereby the European
Commission, several International Financial Institutions –IFIs- (EIB,
EBRD, CEB, KfW, WB, AFD), 20 bilateral donors and 6 beneficiary countries
combine grants and loans to define a common pipeline of priority
investment projects for the Western Balkans. You may find information on
the dedicated website [1]https://www.wbif.eu/ , as well as on the website
of the WBIF platform that covers the private sector and SMEs at

The EIB contributes to the WBIF with: i) its own grants (EUR 10 m); ii) by
using the grants made available by the donors to  the WBIF such as the
European Commission; and iii) with loans granted on its own resources
(approximately EUR 3.3 bn) that are blended with the available grants.

 

The EIB understands that the second paragraph of your request concerns
data on project-level procurement. In this regard, you specifically
request information on:

a)      suppliers commissioned by the beneficiary countries for the
implementation of the projects;

b)     amounts committed and disbursed to each supplier;

c)      tender/contract references where available.

 

With regard to this part of your request, a distinction should be made
between two situations: (i) when the EIB does not directly procure and
(ii) when the EIB does directly procure.

 

Situation (i)

 

The Contracting Authorities are responsible for project-implementation,
including all aspects of the procurement process in accordance with the
EIB Guide to Procurement [2]. In these cases, the main role of the Bank is
to verify whether financing conditions are fulfilled by reviewing the
Contracting Authorities’ procurement decisions in line with the Guide to
Procurement.  With regard to point (a) of your request, the Guide to
Procurement requires the Contracting Authorities to publish in the
Official Journal of the EU all award notices for International Procurement
Procedures. With regard to your other requests, the Bank always disburses
to the Contracting Authorities, which are in charge of procurement,
commitment and disbursement towards their suppliers. We therefore invite

international award notices and to contact the concerned Contracting
Authorities for other requested information, which fall within the remit
of the Contracting Authorities.

 

Situation (ii)

 

This is only the case for a specific type of operations called
Infrastructure Project Facilities (IPFs), under which, on behalf of the
whole WBIF, the EIB tenders EU grants to provide technical assistance
services to the final beneficiaries. In such cases, the EIB is the
Contracting Authority of relevant procurement contracts. You can find
information on the IPF tenders in the Official Journal of the European
Union [4]. This information covers points (a), (b) and (c) of your
request, with the exception of disbursements.

 

In particular, the EIB would like to inform you that, in the 2014-2020
programming period, the Bank awarded service contracts for a total of EUR
180 m under the IPF facilities.

The EIB cannot disclose detailed disbursement data because doing so would
harm commercial interests [5] e.g. by revealing insights into the cash
flows of the parties involved.
