Definition of conflicts of interest

Dear Madam,
 
We refer to your e-mail dated 23/05/2012 in which you make a request for
access to documents, registered under the above mentioned reference
number. You request the documents wherein the working interpretation(s)
used by the Commission for 'conflict of  interest', 'legitimate interest
of the institution', and 'family and personal interests' when implementing
the Staff Regulations are set out.
 
We enclose a copy of the document requested that in Article 14(2) sets the
definition of 'conflict of interest' for the purpose of Article 12b of the
Staff Regulations. Please note that this document cannot be reproduced or
disseminated for commercial purposes without prior consent given by the
Commission.
 
With regards to other term you refer to in your request we regret to
inform you that no documents were found that would correspond to the
description given in your application. The Commission assessment of these
terms is based on case to case approach and it is conducted in the whole
context of Articles 11a, 16 and other relevant provisions of the Staff
Regulations as well as the case law of Court of Justice of European Union.
These terms must be defined and substantiated with regard to the case
under examination and, in principle, cannot be defined in abstract terms
by working interpretations.
