Denying equality.

Dear Court of Justice of the European Union,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

My name is Lucian

I am writing to you for an case where my country being Romania as part of European Union has been given equal rights to make a comparability of education system towards another.

I'm currently working in U.K ( United Kingdom) and I have started and NVQ level 2 in Health and Care.

My dilemma is after I have already asked for a comparability statement and been sent the equality of the schools I have undertaken by NARIC UK and being a certified organisation accredited by the U.K government. Why must I have to re take level 1 English tests and Mathematics in my NVQ level 2 for health and care if my certification states that I am compared to a level 3 NVQ standard in the U.K for studies I have already taken.

The organisation who is dealing with the NVQ in Health and Care doesn't accept the NARIC U.K.

This is an infringement within the framework of laws which those countries has already been agreed upon and it makes discrimination for all the Romanians who will present their studies.

I do state that my qualifications has been compared to the U.K levels and they are above the test i have to undertake.

As my case is due refusal and be denied the early years of school and education i have taken.

This is a whistle-blowing and should be taken seriously as this case could not be a single case of misconduct and could be verified through evidence if required to be presented. My files are ready and waiting to be reviewed by any council deemed to take actions against discrimination.

In reply to your e-mail, it seems appropriate to give some information about the duties and jurisdiction of the Court.

The Court of Justice ensures that in the interpretation and application of the Treaties the law is observed. The interpretation and application of provisions of the national law of the Member States do not form part of its duties. Neither can it hear and determine actions for breach of the European Convention on Human Rights by the authorities of the Signatory States; the Court of Justice is not to be confused with the European Court of Human Rights (see the latter's website at: www.echr.coe.int).

The Court of Justice is not a court of appeal from the national courts and cannot declare their judgments void or vary them.

Private persons may bring proceedings against an institution of the European Union only before the General Court and not before the Court of Justice. In such proceedings representation by a lawyer entitled to practice in a Member State is compulsory.

Disputes with Member States or their authorities, or between private persons fall within the exclusive jurisdiction of the national courts. This is so even where questions of European Union law are concerned. A court of a Member State may (or in certain circumstances, must), however, refer to the Court of Justice for a preliminary ruling on questions of European Union law. The parties themselves have no such right.

The Registrar of the Court of Justice is thus unable to take any steps with regard to your e-mail.
