DG SANCO contacts with biotech industry

We're waiting for David Sánchez to read a recent response and update the status.

Dear Health and Consumers (SANCO),

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

- a list of meetings of DG Health and Consumer officials and/or representatives (including the Commissioner and the Cabinet) and representatives of the following companies and industry associations: Monsanto, Syngenta, Bayer, Basf, Dow, Dupont/Pioneer, EuropaBio, Bussiness Europe, European Crop Protection Association (ECPA), AmCham EU, the US Chamber of Commerce and the European Seed Association (ESA) between January 2012 and today.

- minutes and other reports of these meetings;

- all correspondence (including emails) between DG Health and Consumer officials and/or representatives (including the Commissioner and the Cabinet)and representatives of the following companies and industry associations: Monsanto, Syngenta, Bayer, Basf, Dow, Dupont/Pioneer, EuropaBio, Bussiness Europe, European Crop Protection Association (ECPA), AmCham EU, the US Chamber of Commerce and the European Seed Association (ESA) related to genetically modified organisms between November 2012 and today.

- all correspondence (including emails) between the Commissioner and the Cabinet and DG Health and Consumer related to genetically modified organisms between November 2012 and today.

Dear Mr Sánchez,

Following our telephone conversation yesterday, I am writing to confirm that your application is currently being handled and to thank you for agreeing to extend the time limit for our response.

As I mentioned during our call we will not be in a position to complete the handling of your application within the time limit of 15 working days, which expires on 28 May 2013, given the need to examine a large number of documents in order to identify those falling within the scope of your request, and the legal requirement to consult the third parties concerned.

We would like to thank you for your understanding regarding this matter and to thank you for accepting to find a fair solution as foreseen by Article 6(3) of Regulation (EC) No 1049/2001 regarding public access to documents.

We apologise for this delay and for any inconvenience this may cause. I would be grateful if you would confirm by e-mail that you accept the new proposed time limit (15 July 2013) as agreed on 27 May.

Dear DG Health and Consumers (SANCO),

Thank you for the disclosed documents. After having a closer look at the list of documents falling within the scope of the request 2351/2013, I have a request for further information. In this list, there are numerous documents that are not disclosed based on Art 4 of regulation 1049/2001.

For some of them, it is indicated what the subject of the document is, but for many others, it is not: Annex II 6, 9, 10, 11, 14, 23, 25, 26, 29, 39, 40, 41, 42, 47, 52, 56. Could you provide me with the topics of these documents? Otherwise it is impossible to see why Art 4 applies.

Also, no 36, a BTO of a meeting with EuropaBio on Antibiotic Resistance Marker Genes, is seen as falling within the scope of Art 4 and therefore not disclosed. Could you explain to me why the issue of ARMG is an 'ongoing decision-making process'?

Dear Ms Nolland,

Thank you for your message of 20 November. Please find below the reply to your questions:

• Documents 6, 9, 10, 11, 14, 26, 39, 40, 41, 52, and 56: as mentioned on page 3 of our letter of 2 August 2013, they refer pending feed and food applications or pending GMO applications for cultivation.

• Documents 23, 25, 36, 42, and 47: as mentioned on page 4 of the same letter, they relate to issues where political options are currently being discussed internally within our Directorate General and with the Commissioner: post-market environmental monitoring and antibiotic resistant marker genes.

• Concerning your specific question on document 36, which is a BTO of a meeting with EuropaBio on Antibiotic Resistance Marker Genes, we consider that its disclosure would undermine the decision-making process, as political options are currently being discussed internally within our Directorate General and with the Commissioner. A premature disclosure would therefore seriously undermine the margin of manoeuvre of the Directorate General Health and Consumers and of the Commissioner, who must be free to explore all possible options in a preparation of a decision, without external pressure. Indeed, a series of GMOs containing antibiotic resistance marker genes are currently being assessed in order to take a decision.
