Directive 2017/1132 and its applicability/impact on third-country mergers, such as when a Swiss company merges to an EU company

We're waiting for Robert Junge to read a recent response and update the status.

Dear Legal Service,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

I am specifically looking for case law which showcases/includes the use of Directive 2017/1132 for a mergersbetween an EU company (e.g. a German company) with a third-country company, preferably Switzerland but other third-countries will work as well.

Furthermore, if there are any EU documents which discuss the issue of a third-country company (e.g. Switzerland) merging with an EU based company, preferably where the surviving company ends up in the EU, I would be very grateful to receive those as well.
