The scope of your request, namely as regard point 3 and 4, is really
wide. Its handling involves the assessment of a very large number of
documents, partly originating from third parties (EUI, EUI Member States,
external stakeholders), which need to be assessed individually. The
analysis of these documents, together with the need to consult the third
parties concerned in accordance with Article 4(4) 4(5) of Regulation (EC)
No 1049/2001, cannot be expected to be completed within the normal time
limits set out in Article 7 of Regulation (EC) No 1049/2001.

 

Due to the wide scope of your request, its handling would involve the
search and assessment of many documents. According to our first
estimates, the handling of your request would take [41] working days,
broken down as follows:

 

-                      identification of the documents falling under your
request: [2] working days;

-                      retrieval and establishment of a complete list of
the documents identified: [3] working days;

-                      scanning of the documents: [8] working days;

-                      assessment of the content of the documents in light
of the exceptions of Article 4 of Regulation (EC) No 1049/2001: [4]
working days:

-                      third-party / Member State consultations under
Article 4(4) and 4(5) of Regulation (EC) No 1049/2001: [5] working days];

-                      final assessment of the documents in light of the
comments received: [2] working days];

-                      drafting of the reply: [2] working days;

-                      redaction of those parts of the documents to which
one or several exceptions apply: [6] working days;

-                      internal review and approval of the draft decision:
[5] working days; and

-                      preparation of the reply and the documents for
dispatch (scanning of the redacted versions, administrative processing
etc.): [4] working days.

 

However, Article 6(3) of Regulation 1049/2001 also provides for a
possibility to confer with an applicant informally with a view to finding
a fair solution when an application relates to a very long document or
concerns a very large number of documents.

In accordance with the case law of the EU Courts, such a solution can only
concern the content or the number of documents requested, not the deadline
for replying (Judgment of the Court of Justice of 2 October 2014,  Strack
v European Commission, C-127/13). This means that the scope of the request
must be reduced in a way that would enable its processing within the
extended deadline of 15 + 15 working days.

 

Based on the above-mentioned provision, we would kindly ask you to specify
the objective of your application and your specific interest in the
documents requested, and whether you could narrow down the scope of your
application, mainly with regard to the subject matters so as to reduce it
to a more manageable amount of documents.

According to our first estimates and taking into account the other ‘access
to documents’ requests being handled within DG EAC at the same time, the
global administrative burden of the concerned staff during the same
period, the human resources available, the need to safeguard good
administration and the extraordinary circumstances due to the Covid-19
outbreak, we estimate that only a maximum of 20 documents can be dealt
with in the remaining time. We therefore kindly ask you to specify the
documents you are interested or help us identifying them.

 

In order to help you to narrow down your application, please note that the
following categories documents have been identified as falling under the
scope of your request:

 

-                      Legislative documents and documents preparing the
legislation of the Erasmus+ regulation and previous programmes

-                      Documents of the EUI with regard to the
Commission’s membership in governance bodies of the EUI

-                      Documents of the EUI as beneficiary of EU
(operating) grants and project grants

-                      Correspondence between the EUI and several
Commissioners, Director Generals and other senior officials of the
European Commission since 1972

-                      Various internal notes, briefings etc.

 

In order to enable us to respect the time-limits of Regulation (EC) No
1049/2001, we would ask you for a swift reply to our invitation to propose
a fair solution, within five working days at the latest.

Regarding points 3 and 4, I would like to suggest to narrow the scope of the request as follows.

3. All documents or a summary which provides the funding given to the European University Institute by the EU from 2015 to 2020 inclusive, per year. I am looking for the names of the projects, the name of the department/s providing the funding, and any other details available concerning the funding.

Thank you for your reply.
Your application is currently being handled as suggested. However, we will
not be in a position to complete the handling of your application within
the time limit of 15 working days, which expires today 9/02/2021.
An extended time limit is needed as
•       the application concerns a very large number of documents;
•       in order to retrieve the documents requested, large files have to
be examined;
•       the application concerns documents held by different Services,
which must be consulted.

Therefore, we have to extend the time limit with 15 working days in
accordance with Article 7(3) of Regulation (EC) No 1049/2001 regarding
public access to documents. The new time limit expires on 2/03/2021.

We apologise for this delay and for any inconvenience this may cause.
