Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

All correspondence (including emails and WhatsApp messages) between the European Commission Migration and Home Affairs and the International Centre for Migration Policy Development (ICMPD) since 02/03/2016

We refer to your request dated 24 August 2022 in which you make a request for access to documents, registered on 25 August 2022 under Gestdem reference number 2022/4794.

The description given in your application under point 1°, i.e. All correspondence (including emails and WhatsApp messages) between the European Commission Migration and Home Affairs and the International Centre for Migration Policy Development (ICMPD) since 02/03/2016, does not enable us to identify concrete documents which would correspond to your request.

We therefore invite you, pursuant to Article 6(2) of Regulation (EC) No 1049/2001 regarding public access to documents, to provide us with more detailed information on the documents which you seek to obtain, such as references, dates or periods during which the documents would have been drawn up, persons or bodies who drafted the documents etc.

In accordance with Article 2, third paragraph of the Implementing Rules to Regulation (EC) No 1049/2001, the 15 working days time limit for handling your application will start running when we receive the requested clarifications. Please disregard the previously announced deadline in our email dated 25 August 2022.

The names of the Home and Affairs representatives and the dates of their meetings with ICMPD are already mentioned in our first request. We believe the request was relatively specific and should allow you to at least identify at least the minutes of these meetings. As for the paragraph mentioned in your request for clarification, the persons who would exchange emails and Whatsapp messages with ICMPD are likely to be the same Migration and Home Affairs officials who met with ICMPD in the aforementioned meetings. If it helps, the ICMPD representative in charge of EU relations is Ralph Genetzke and the ICMPD representatives accredited with access to the EU Parliament are Philipp Nigitsch, Marissa Weigle and Sarah Schlaeger. It might be helpful to use their names in your search for documents, although their accreditation started in 2022, while we are looking for documents and meetings that had taken place before that (and perhaps other ICMPD representatives were accredited during that time?). I am filing the following confirmatory application with regards to my access to documents request 'Documents from ICMPD lobbying meetings' registered on 25 August 2022 under Gestdem reference number 2022/4794.

On 8 September 2022 Migration and Home Affairs responded to my application asking for clarification "pursuant to Article 6(2) of Regulation (EC) No 1049/2001 regarding public access to documents". I responded with clarification on 29 September 2022. Migration and Home Affairs have not responded to this clarification.
