Dear Competition,

In accordance with Regulation 1049/2001, Regulation 1367/2006 and the Charter of Fundamental Rights, ClientEarth AISBL hereby requests access to documents pertaining to the following two draft delegated regulations published for feedback on 20 May 2022 under Directive (EU) 2018/2001 (collectively, the ‘Proposed Delegated Acts’):

(1) draft delegated regulation establishing a minimum threshold for greenhouse gas emissions savings of recycled carbon fuels and by specifying a methodology for assessing greenhouse gas emissions savings from renewable liquid and gaseous transport fuels of non-biological origin and from recycled carbon fuels (Ref: Ares(2022)3836721), and

(2) draft delegated regulation establishing a Union methodology setting out detailed rules for the production of renewable liquid and gaseous transport fuels of non-biological origin (Ref: Ares(2022)3836651).

Specifically, ClientEarth requests access to the following:

(a) Documents revealing the existence of meetings that have taken place since 1 January 2021 between DG COMP staff on the one hand and representatives of external parties (including but not limited to lobby consultancies and law firms) on the other hand, in which one or both of the Proposed Delegated Acts were mentioned;

(b) Minutes and other reports of these meetings;

(c) All correspondence (including emails, letters, attached documents and enclosures) since 1 January 2021 between DG COMP staff on the one hand and representatives of external parties (including but not limited to lobby consultancies and law firms) on the other hand, in which one or both of the Proposed Delegated Acts were mentioned.
