Dear Internal Market, Industry, Entrepreneurship and SMEs,

Many thanks for your response. My request is a clarification and continuation of my request made in February 2017 (Gestdem 2017/0904). Although the European Commission disclosed several documents with regard to meetings between industry and DG Grow officials on the Preparatory Action on Defence Research, the Commission judged that several other documents fell outside the scope of my request as they were briefings (letter dated on 30.01.2018, C(2018) 632 final). The Commission stated that:

"Notwithstanding the fact that those briefings are linked to the subject of the Preparatory Action on Defence Research, they are by their nature preparatory purely internal documents which do not qualify as correspondence with the industry."

As such the European Commission judged that 29 of the initially identified documents related to meetings between DG Grow and industry representatives on the PADR did not fall inside the scope of my request.

The current request tries to broaden Gestdem 2017/0904 by asking for all documents which are related to meetings between:
1) Industry representatives (including lobby consultancies and law firms, and/or industry associations) and DG Growth officials;
2) On the subject of the Preparatory Action on Defence Research;
3) Since January 2015.

These documents include, but are not limited to internal briefings, correspondence, minutes, preparatory documents and other reports related to those meetings;

My request does not cover already disclosed documents under Gestdem 2017/0904. Additionally, to the extent that this request covers the same scope as Gestdem 2018/2431 and Gestdem 2017/7037, these documents may also be excluded from the current request.

I hope this clarifies the scope of my request.

Yours faithfully,

Bram Vranken

Please note that the 15 working days time limit for handling your application started running from 07/08/2018, the day we received the requested clarifications. Therefore, the deadline to reply to your application is set on 29/08/2018.

In case this time limit needs to be extended, you will be informed in due course.

Dear Mr Vranken,

We refer to your e-mail dated 23/07/2018 in which you make a request for
access to documents, registered on 25/07/2018 under the above mentioned
reference number.

Your application is currently being handled. However, we will not be in a
position to complete the handling of your application within the time
limit of 15 working days, which expires on 29/08/2018 (following your

accordance with Article 7(3) of Regulation (EC) No 1049/2001 regarding
public access to documents. The new time limit expires on 19/09/2018.

We apologise for this delay and for any inconvenience this may cause.

I am filing the following confirmatory application with regards to my access to documents request 'Documents related to industry meetings on PADR'.

Dear Secretariat General,

I would like to point out that under Regulation 1049/2001 the maximum amount of time for a EU institution is 30 working days and only in the case of a large amount of documents.

Can you confirm that the request indeed covers a large amount of documents? And can you indicate when you will be finished with assessing my application?

In the past year I have filed FOI requests on several occasions and on each of these instances the waiting time was extremely long, far exceeding the legal time period. I want to remind you that the right to access to information is a fundamental right.

I hope you can provide an answer to my questions, otherwise I will have to consider taking further steps.

Yours sincerely,

Bram Vranken
