EDPB-Taskforce documents regarding NOYB 101 complaints
Dear European Data Protection Board,
1 CONTEXT:
On the website of the NGO "NOYB", a recent announcement reports about an "EDPB task force": https://noyb.eu/en/austrian-dsb-eu-us-da.... Wording:
"In a groundbreaking decision, the Austrian Data Protection Authority ("Datenschutzbehörde" or "DSB") has decided on a model case by noyb that the continuous use of Google Analytics violates the GDPR. This is the first decision on the 101 model complaints filed by noyb in the wake of the so-called "Schrems II" decision. In 2020, the Court of Justice (CJEU) decided that the use of US providers violates the GDPR, as US surveillance laws require US providers like Google or Facebook to provide personal details to US authorities. Similar decisions are expected in other EU member states, as regulators have cooperated on these cases in an EDPB "task force". It seems the Austrian DSB decision is the first to be issued."
My request refers to this passage.
2 REQUESTS:
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
(1) All EDPB documents indicating which data protection supervisory authorities are organized in this "task force". Personal data can of course be blacked out.
(2) All legal opinions available to the EDPB regarding the interpretation of Articles 44-49 of the GDPR issued by the EDPB and/or another data protection supervisory authority in the context of this task force, regardless of the specific context (e.g., data processing services, service providers, countries). Personal data can of course be blacked out.
Yours faithfully,
Heiko Roth
Thank you for your message and for your interest in data protection. We
will look into your request and get back to you within due time.
The EDPB Secretariat
Dear Mr. Roth,
Thank you for your message.
In order to enable us to identify the documents in scope, could you please clarify what is meant by "legal opinions" in the second part of your request?
Thank you in advance for your cooperation.
Best regards
EDPB Secretariat
Dear European Data Protection Board,
"Legal opinions" means any kind of information dealing with the legal interpretation of one or more legal norms. In particular, it means: legal opinions, studies, comparisons of legal systems, which either refer to a norm in general or a norm is applied in the context of a specific fact.
Yours sincerely,
HR

Dear Mr Roth,
We refer to your email dated 13/01/2022 in which you made a request for
access to documents, registered on 19/01/2022 under reference number
2022/06.
Your application is currently being handled. However, we will not be in a
position to complete the handling of your application within the time
limit of 15 working days, which expires today (09/02/2022).
An extended time limit is needed, as your application covers a
considerable number of documents for whose identification and assessment
we need more time, due to the high amount of cases currently being dealt
with by our team.
Therefore, we have to extend the time limit for another 15 working days in
accordance with Article 7(3) of Regulation (EC) No 1049/2001 regarding
public access to documents. The new deadline expires on 02/03/2022.
We apologize for this delay and for any inconvenience this may cause.
Yours sincerely,
On behalf of
Ventsislav Karadjov, deputy chair of the EDPB
