Dear Research and Innovation,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

I would like to know how Frameworks Programmes are elaborated, decided, voted (which institutional actors and stakeholders are involved)?

I also want to know the role and influence of the Joint Research Center in this process.

Finally, could you tell me the name and date of the first citizen evaluation project planned by the Framework Programmes (I think it was in the 4th one)?

We are writing concerning your request which we consider a request for information relating to Research Framework programmes under the Code of Good Administrative Behaviour and not as request for access to documents under Regulation 1049/2001 , given that you are not referring to specific documents but about information in general.

Concerning the first point of your request, In general you the procedure on how Frameworks Programmes are elaborated, decided, voted is described in the Treaty on the Functioning of the European Union (Art 180, 182 et seq.)

In relation to the first question, the Treaty explains the general procedure, but it does not say who in the Commission proposes the FP, and which committee in the Parliament (or which specific working group in the Council) is responsible for co-developing the FP.

For the JRC, they referred me directly to you, and did not want to answer me directly...

Answering to your follow up question,

Apart from the general procedure described in the treaty, kindly note that the adoption of a new framework programme (hereinafter FP) includes the preparation of an impact assessment, the preparation of the Commission proposals and the adoption of the various legislative acts by the European Parliament and the Council to establish the particular FP.

FPs are intercollegiate documents which require multidisciplinary work and therefore involve numerous units of the directorate/s-general concerned, as well as interservice and stakeholders consultations before the final proposal is sent to the European Parliament. The Commission need to present an impact assessment which aims to assess if the programme is justified and well designed in order to achieve the policy objectives. In parallel, the Commission begins drafting the proposals for the required legislative acts which are submitted to inter-service consultation and then adopted by the Commission and transmitted to the legislators together with the impact assessment.

Also, the preparation of the new FP legislative acts takes numerous evaluations and studies into account. The adoption of the legislative acts to establish a FP follow one these two different procedures, the ordinary legislative procedure or the consultation procedure.
