I am filing the following confirmatory application with regards to my access to documents request registered on 25/09/2018 under reference number GestDem 2018/5002.

First let me note that there has been an unacceptable delay for replying to my request. Normally, the Commission should have replied by 16 October 2018, a deadline which was postponed until 8 November 2018, which the regulation allows under exceptional circumstances. While the Commission has apologised for the delay, the only reason given for the delay was that “internal consultations” had not yet been “finalised” - which does not point to an exceptional circumstance. Moreover, since the result of the search is that reportedly no document has been found that match the description, this makes it even more difficult to accept that the Commission would need such a long time to arrive at its conclusion.

Regardless, I do not believe that the Commission does not hold any documents that match my description, i.e. all documents including but not limited to letters, sent by the European Space Agency to the European Commission with comments on the Proposal for a REGULATION OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL establishing the space programme of the Union and the European Union Agency for the Space Programme.

A spokeswoman from the European Space Agency has confirmed to me that ESA has indeed sent such a letter in July 2018, with the Commission in cc. Is the Commission claiming that this letter has never arrived?
