We refer to your access to documents request of 25th July, sent via the
“Ask the EU.org” platform regarding the Volkswagen Antrieb RDI project. We
also refer to our acknowledgment of receipt of 27th July.

 

Your request has been handled under the provisions of the EIB Group
Transparency Policy.

 

Please find attached two documents corresponding to your request: the
Finance contract, which lists the conditions attached to the EIB loan; and
the latest project completion report provided by the VW Group and related
to the use of the EIB loan.

 

Information in these documents which is covered by the exceptions provided
for in the EIB Transparency Policy (namely Articles 5.5 and 5.6) has been
replaced by the symbol “[...]” or has been blackened out. This concerns
financial and technical information which, if disclosed, would undermine
the protection of the promoter’s commercial interests and its intellectual
property rights. None of the information removed from these documents
relates to the environment.

Kindly note that this loan has matured in 2014 and was repaid in
accordance with its terms.

Dear EIB,

The documentation you have sent is incomplete. In the e-mail, you note that "the Finance contract" .. "lists the conditions attached to the EIB loan". However, that document merely states:

"Die DARLEHENSNEHMERIN wird die auf das PROJEKT anwendbaren Umweltvorschriften des EU Rechts und deutschen Rechts beachten."

This sentences says that the environmental conditions need to be fulfilled, but it does not list any specific conditions. I would like to see the specific conditions attached to the loan.

Secondly, "the latest project completion report provided by the VW Group and related to the use of the EIB loan" also says nothing concrete about the fulfilment of environmental conditions. It refers to a web page, which no longer exists, and to attachments, i.e. "Umweltpredikät und Hintergrundbericht - Golf" and "Umweltpredikät und Hintergrundbericht - Passat", which were not included in the released documents.

We refer to your follow-up request of 25^th August 2016, sent via the “Ask
the EU.org” platform regarding the Volkswagen Antrieb RDI project. We also
refer to our acknowledgment of receipt of 26^th August 2016.

 

With regard to the project’s Finance Contract, we have reviewed our
initial reply and identified an environmental reporting requirement which
had been inadvertently omitted in our previous response.  We apologise for
this oversight and are pleased to enclose a revised version of the
document.

 

We would however like to confirm that no specific environmental
conditions, other than the undertaking of the borrower to observe the EU
and German environmental laws applicable to the project, were included in
the Finance Contract.  In light of this comprehensive undertaking no
specific environmental conditions were included in the contract.

 

As stated in our initial response, and in line with the EIB Group
Transparency Policy, other non–environmental information contained in this
document, such as financial or technical information, cannot be disclosed,
as such disclosure would undermine the promoter’s commercial interests or
intellectual property rights.

 

With regard to the project completion report, we understand that the link
included in the document

refers to the promoter’s website where the attachments were available. We
are pleased to enclose them for your ease of reference[2][1].
