EU Code of Practice on Disinformation

Dear Communications Networks, Content and Technology,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting the following documents:

1. For the development and drafting of the EU Code of Practice on Disinformation that was agreed upon in October 2018:

a) All correspondence – including, but not limited to, letters, e-mails, and any attachments – exchanged between European Commission representatives and any other actor (including, but not limited to, signatories of the Code of Practice and representatives of those signatories);
b) All records of meetings held on this issue. This may include, but not necessarily limited to, minutes of the meeting(s), verbatim reports of the meeting(s), transcripts etc, that would provide a record of the proceedings of the meetings(s).
c) Any lists of attendees from the aforementioned meeting(s), including the name of the company, group, or organisation of any kind each attendee represents;
d) Any invitations sent to actors or stakeholders for their involvement in the drafting of the Code of Practice.
e) Any drafts of the Code of Practice and any feedback associated with those drafts.

2. For the development of the monthly intermediate targeted monitoring reports of the EU Code of Practice on Disinformation released in January, February, March, April and May 2019 as well as the Analysis of the First Annual Reports released October 2019:

a) All correspondence – including, but not limited to, letters, e-mails, and any attachments – exchanged between European Commission representatives and any other actor (including, but not limited to, signatories of the Code of Practice and representatives of those signatories);
b) All records of meetings held on this issue. This may include, but not necessarily limited to, minutes of the meeting(s), verbatim reports of the meeting(s), transcripts etc, that would provide a record of the proceedings of the meetings(s).
c) Any drafts of the intermediate targeted monitoring reports on the Code of Practice and any feedback associated with those drafts.

3. For the selection process for the independent consultant engaged by the Commission to evaluate the Code of Practice on Disinformation as finalised in December 2019:

a) Submissions and/or tenders, and their annexes, from consultancies applying for this contract.
b) Any indicators used to assess the submissions.
c) All correspondence – including, but not limited to, letters, e-mails, and any attachments – regarding the deliberation or selection of the candidates;

As your request is addressed to DG CONNECT we understand that the request
concerns documents originating from or hold by DG CONNECT.

Your application concerns a large number of documents. At this stage, we
have identified several hundreds of documents.

The identified documents need to be assessed individually, according to
Regulation (EC) No 1049/2001 on public access to documents (hereinafter
'Regulation 1049/2001'). Moreover, the handling of your request involves
the assessment of a very large number of documents originating from third
parties. The analysis of these documents, together with the need to
consult the concerned third parties in accordance with Article 4(4) of
Regulation 1049/2001, cannot be expected to be completed within the normal
time limits set out in Article 7 of Regulation 1049/2001.

However, Article 6(3) of Regulation 1049/2001 also provides for a
possibility to confer with an applicant informally with a view to finding
a fair solution when an application relates to a very long document or
concerns a very large number of documents.

In accordance with the case law of the EU Courts, such a solution can only
concern the content or the number of documents requested, not the deadline
for replying. This means that the scope of the request must be reduced in
a way that would enable its processing within the extended deadline of 15
+ 15 working days.

The work needed to deal with your application would cover the following
steps:

- Multiple searches for the identification of the documents which fall
within the scope of the request in several document management systems,

- Retrieval and establishment of a complete list of the documents falling
under the scope of your requests,

 - Scanning of the documents which are not in pdf format,

- Preliminary individual Assessment of the content of the documents in
light of the exceptions contained in Article 4 of Regulation 1049/2001,

- Third party consultations under Article 4(4) and / or 4(5) of Regulation
1049/2001,

- Final assessment of the documents in light of the comments received,

- Redaction of those parts of the documents to which one or several
exceptions apply,

- Preparation of the draft reply,

  - Finalisation of the reply at administrative level and formal approval
of the draft decision

- Preparation of the reply and the documents for dispatch.

 

Based on the above-mentioned provision, we would kindly ask you to specify
the objective of your application and your specific interest in the
documents requested (Judgment of the Court of Justice of 2 October 2014, 
Strack v European Commission, C-127/13), and whether you could narrow down
the scope of your application (i.e. the subject matter(s) and/or timeframe
covered), so as to reduce it to a more manageable amount of documents.

In order to help you to narrow down your request, please note that the
following categories of documents have been identified as falling under
the scope of your request.

• Under Point 1 “For the development and drafting of the EU Code of
Practice on Disinformation that was agreed upon in October 2018”: more
than two hundred documents, in particular:

- Minutes and reports from meetings between the Commission services and
stakeholders

- Email exchanges between Commission services and different stakeholders
relating to Multi stakeholder Forum working on the Code of Practice (e.g.
invitations, administrative communications regarding the meetings, minutes
of such meetings, etc.)

• Under Point 2 “For the development of the monthly intermediate targeted
monitoring reports of the EU Code of Practice on Disinformation released
in January, February, March, April and May 2019 as well as the Analysis of
the First Annual Reports released October 2019”: less than hundred
documents, in particular

- Email exchanges between Commission services and different stakeholders,
which are signatories of the Code of Practice, progress reports and
self-assessments, and the evaluation reports of the Commission, etc.

• Under Point 3 “For the selection process for the independent consultant
engaged by the Commission to evaluate the Code of Practice on
Disinformation as finalised in December 2019”: about 15 administrative
documents were identified, in particular

- Call for tenders and its attachments

- Approvals of publishing them and financing the contract

- Record of the opening session,

- Evaluation report

- Award decision

- Signed contract

Please, note that it was not an open call but the EC used its framework
contract system. Three pre-selected consortia were invited but only one of
them submitted a proposal. The study was commissioned from this
consortium.  

According to our estimates and taking into account the other access to
documents’ requests being handled within DG CONNECT at the same time, the
global workload of the concerned staff during the same period, the human
resources available and the need to safeguard good administration, we
estimate that a maximum of 20 documents could possibly be dealt with
within the remaining days from the extended deadline of 30 working days
counting from the date of registration of your application (08/05/2020).

We therefore propose, as a fair solution, that you narrow the scope of
your request based on the description listed above and we will
consequently assess, under Regulation 1049/2001  a maximum of 20
documents  relating to the topics you are interested in. In case you are
interested in a topic with more than 20 documents, we would choose the 20
most recent ones.

In order to enable us to respect the time limits of Regulation 1049/2001,
we would ask you for a swift response to our proposal for a fair solution,
and within three working days at the latest, i.e. by Friday 5^th June eob
at the latest.

restrict the scope of your application to those parts that can be dealt
with within the extended deadline of 30 working days counting from the
date of registration of your application.

position to complete the handling of your application within the time

An extended time limit is needed as your application concerns a very large
