Dear Mr Dohle,

 

We are writing concerning your request for access to Commission documents
registered on 20 February 2023 under case number 2023/1130.

 

We are currently working on your request. However, we have not yet been
able to gather all the elements necessary to carry out a full analysis of
your request therefore why we have not been able to send you the reply
within the prescribed time limit that expired on 13 March 2023. This daily
is mainly to the fact that the documents need to be retrieved in hard copy
from the Commission archives and were not available in electronic form.

 

Therefore, in line with Article 7(3) of [1]Regulation (EC) No 1049/2001,
we need to extend this time limit by 15 additional working days. The new
time limit expires on 3 April 2023.

As you can see in previous communications, we are the DG on the lead of
handling this dossier. You can address any additional message to this

Please bear in mind that for future request we advise applicants to use
the new Transparency portal of the Commission [[2]Electronic Access to
Commission Documents (EASE) (europa.eu)] as sometimes we experience issues
with the automatic email addresses generated by Ask the EU.

 

We apologize for the additional delay that this request is experiencing,
and we would like to share some details on the process that we consider it
may be useful.

 

As we communicated in the initial holding reply, we were doing a search
from the Commission archives given the time when the meeting took place,
please consider that the archives are not in the same location than our
offices. When the document was found, it was bearing a marking which means
that was deemed to be sensitive when it was drafted, therefore this
obliged us to do a more in-depth analysis, and to be cautious with the
handling of the request.

 

Finally, given that the document is the minutes of a meeting attended by
several interlocutors including Croatian authorities, as per Art.4 of the
Regulation 1049/2001, paragraphs 4 and 5 we are in the process of
consultation which also take some time;

“4. As regards third-party documents, the institution shall consult the
third party with a view to assessing whether an exception in paragraph 1
or 2 is applicable, unless it is clear that the document shall or shall
not be disclosed.

5. A Member State may request the institution not to disclose a document
originating from that Member State without its prior agreement”.

 

We are confident that we will reach a final conclusion soon so we
apologize again for the delay and hope that the additional explanations
may be useful.
