EU CYBRID 2017 - Scenario documents and ministerial responses

Dear Sir,
We refer to your e-mail dated 19/07/2018 wherein you make a request for
access to documents.
You request access to all documents that contain the following
information: "EU CYBRID 2017 scenario documents that were given to the
ministerial participants and their responses to the scenario questions and
challenges posed".
Based on the description provided in your request, we were able to
identify three documents falling under the scope of your request. The
documents in question originate from a Member State. In accordance with
Articles 4(4) and 4(5) of [1]Regulation 1049/2001, we have consulted the
relevant Member State, which objected the disclosure of the documents.
Therefore, we regret to inform you that your application cannot be
granted as disclosure is prevented by the exceptions to the right of
access laid down in Article 4 of this Regulation, notably Article 4(1)(a)
first, second and third indent. All three of the documents contain
sensitive information, i.e. specifics related to the conducting of the EU
CYBRID 2017 exercise, the outcomes of the exercise, as well as specific
answers given by representatives of different Member States in the course
of the exercise. Disclosure of the document would therefore undermine the
interests protected under Article 4(1)(a), namely public security, defence
and military matters, and international relations.
We have considered whether partial access could be granted and concluded
that even such an access would undermine the interests protected under
Article 4(1)(a) first, second and third indent. Therefore, disclosure of
the documents requested cannot be provided as a whole.
Please further note that the exceptions set out in Article 4(1) are
absolute in nature and therefore not balanced by an overriding public
interest in disclosure.
Means of redress
In accordance with Article 7(2) of Regulation 1049/2001, you are entitled
to make a confirmatory application requesting EDA to review its position.
Such a confirmatory application should be addressed within 15 working days
upon receipt of this letter to the Chief Executive of EDA to the following
