Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting copies of documents relating to the programme to develop a European Medium Altitude Long Endurance unmanned aerial system (Euro MALE UAS) which may be held by the European Defence Agency:

We refer to your e-mail dated 19 December 2018 in which you make a request for access to documents.

You have requested access to the following documents:

- Preliminary design review (high level summary document containing conclusions and - recommendations) for the programme;
- User requirement document(s) (or equivalent) for the programme;
- Project specification document(s) (or equivalent) for the programme;

We regret to inform you that the European Defence Agency does not hold any documents that would correspond to the description given in your application.

Please note that the European Defence Agency contributed to the preparation of the European MALE RPAS Programme and is providing support to OCCAR on specific topics to facilitate the development of this future European capability.

The programme was formally established in 2016 by four EU Member States in the OCCAR framework. As a consequence, all documents related to the management of this programme are OCCAR documents distributed by OCCAR only among the States directly involved in the programme. Hence, the European Defence Agency does not hold the documents you have requested.

As specified in Article 2(3) of Regulation 1049/2001, the right of access as defined in that Regulation applies only to existing documents in the possession of the institution.

Given that no such documents, corresponding to the description given in your application, are held by the European Defence Agency, the latter is not in a position to fulfil your request.

Means of redress

In accordance with Article 7(2) of Regulation 1049/2001, you are entitled to make a confirmatory application requesting the European Defence Agency to review its position.

Such a confirmatory application should be addressed within 15 working days upon receipt of this letter to the Chief Executive of the European Defence Agency to the following email: [EDA request email].
