Exemptions from EU Law

The request was refused by Council of the European Union.

Dear Council of the EU,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

- A list, sorted by the name of the Member State concerned, of all clauses and the legal effect of each clause each Member State is exempt from under EU law. e.g. Denmark is not in the Euro, as per X.X clause of the Lisbon Treaty / Regulation xxxx/yyyy / Directive aaaa/bbbb.
- A list, sorted by the name of the Member State concerned, of all clauses and the legal effect of each clause each Member State is to become exempt from under proposed EU law. e.g. it is proposed 'special single limb' Collective Action Clauses (CACs) will apply to all Eurozone members in future bond contracts to reduce the power of holdout creditors who resist haircuts to bonds, with only Italy being exempt from this EU law.

If there are time limits or other special features of the exemption concerned, please detail this too.

Thank you again for your message to the General Secretariat of the Council.

Unfortunately, as we have already informed you in our previous communication, we cannot provide you the documents because, as said, we don't have them.

The Council negotiates and adopts legislative acts but the Council does not produce any research paper, we are not a research institute.

It is the nature of the Universities and other professionals to gain the legislation and create papers/books/studies as you are looking for.

We are to your disposal for all information regarding our competences.
